HEARING OFFICER ORDER
On August 21, 2008, the law firm of respondent’s attorney reported that
respondent’s attorney was deceased. The law firm requested cancellation of the August
25, 2008 status conference to give respondent the opportunity to seek new counsel.
Complainant advised the hearing officer that the Illinois Environmental Protection
Agency agrees that respondent does not have the ability to pay the current penalty
demand, and the parties are discussing a new amount.
The parties are directed to participate in a telephone status conference with the
hearing officer at 10:30 a.m. on October 27, 2008. The status conference shall be
initiated by the complainant.
IT IS SO ORDERED.
