JURISDICTION
This Administrative Citation is issued pursuant to the authority vested in the Illinois
Environmental Protection Agency by Section 31.1 of the Illinois Environmental Protection Act, 415
ILCS 5/31.1 (2006).
FACTS
1.
That Brian Bellemey ("Respondent") is the present owner of a facility located in the
500 block Madison Avenue in Junction City, Marion County, Illinois. The property is commonly
known to the Illinois Environmental Protection Agency as Junction City/Bellemey.
2.
That said facility is an open dump operating without an Illinois Environmental
Protection Agency Operating Permit and is designated with Site Code No. 1210205002.
3.
That Respondent has owned said facility at all times pertinent hereto.
4.
That on July 23, 2008, Michelle Cozadd of the Illinois Environmental Protection
Agency's Collinsville Regional Office inspected the above-described facility. A copy of her
inspection report setting forth the results of said inspection is attached hereto and made a part
hereof.

VIOLATIONS
Based upon direct observations made by Michelle Cozadd during the course of her July 23,
2008 inspection of the above-named facility, the Illinois Environmental Protection Agency has
determined that Respondent has violated the Illinois Environmental Protection Act (hereinafter, the
"Act") as follows:
(1)
That Respondent caused or allowed the open dumping of waste in a manner
resulting in litter, a violation of Section 21(p)(1) of the Act, 415 ILCS 5121(p)(1)
(2006).
(2)
That Respondent caused or allowed the open dumping of waste in a manner
resulting in the deposition of general construction or demolition debris; or clean
construction or demolition debris, a violation of Section 21(p)(7) of the Act, 415 ILCS
5/21(p)(7) (2006).
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2006), Respondent is
subject to a civil penalty of One Thousand Five Hundred Dollars ($1,500.00) for each of the
violations identified above, for a total of Three Thousand Dollars ($3,000.00). If Respondent elects
not to petition the Illinois Pollution Control Board, the statutory civil penalty specified above shall be
due and payable no later than October 15, 2008, unless otherwise provided by order of the Illinois
Pollution Control Board.
If Respondent elects to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31.1 of the Act, 415 ILCS 5/31.1 (2006), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondent shall be assessed the associated hearing costs incurred by the Illinois Environmental

Protection Agency and the Illinois Pollution Control Board. Those hearing costs shall be assessed
in addition to the One Thousand Five Hundred Dollar ($1,500.00) statutory civil penalty for each
violation.
Pursuant to Section 31.1(d)(1) of the Act, 415 ILCS 5/31.1(d)(1) (2006), if Respondent fails
to petition or elects not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and findings of violation as
alleged herein, and shall impose the statutory civil penalty specified above.
When payment is made, Respondent's check shall be made payable to the Illinois
Environmental Protection Trust Fund and mailed to the attention of Fiscal Services, Illinois
Environmental Protection Agency, 1021 North Grand Avenue East, P.O. Box 19276, Springfield,
Illinois 62794-9276. Along with payment, Respondent shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of the
Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondent from the date payment is due up to and including the date that payment is
received. The Office of the Illinois Attorney General may be requested to initiate proceedings
against Respondent in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued.

PROCEDURE FOR CONTESTING THIS
ADMINISTRATIVE CITATION
Respondent has the right to contest this Administrative Citation pursuant to and in
accordance with Section 31.1 of the Act, 415 ILCS 5/31/1 (2006). If Respondent elects to contest
this Administrative Citation, then Respondent shall file a signed Petition for Review, including a
Notice of Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois
Pollution Control Board, State of Illinois Center, 100 West Randolph, Suite 11-500, Chicago, Illinois
60601. A copy of said Petition for Review shall be filed with the Illinois Environmental Protection
Agency's Division of Legal Counsel at 1021 North Grand Avenue East, P.O. Box 19276, Springfield,
Illinois 62794-9276. Section 31.1 of the Act provides that any Petition for Review shall be filed within
thirty-five (35) days of the date of service of this Administrative Citation or the Illinois Pollution
Control Board shall enter a default judgment against the Respondent.

Affiant is a field inspector employed by the Division of Land Pollution Control of the
Illinois Environmental Protection Agency and has been so employed at all times pertinent
hereto.
2.
On July 23, 2008, between 1:05 PM and 1:20 PM, Affiant conducted an inspection of a
disposal site operated without an Illinois Environmental Protection Agency permit,
located in Marion County, Illinois, and known as Junction City/Bellemey by the Illinois
Environmental Protection Agency. Said site has been assigned site code number LPC
#1210205002 by the Illinois Environmental Protection Agency.
3.
Affiant inspected said Junction City/Bellemey open dump site by an on-site inspection
that included walking and photographing the site.
4.
As a result of the activities referred to in paragraph 3 above, Affiant completed the
Inspection Report foini attached hereto and made a part hereof, which, to the best of
Affiant's knowledge and belief, is an accurate representation of Affiant's observations and
factual conclusions with respect to said Junction City/Bellemey open dump.

The purpose of this memorandum is to serve as the narrative for a July 23, 2008 inspection
conducted at the above referenced site. The inspection took place between 1:05 pm and 1:20 pm.
Seven digital photographs were taken. The weather conditions were sunny and approximately 80°F.
Mr. Bob Glammeyer was interviewed briefly at the start of the inspection.
The 6.7-acre site is located in the 500 block of Madison Avenue in Junction City, Illinois.
Specifically, the site is located in part of the North 1/2, Northeast 1/4 of Section 31 in Township 2
North and Range 1 East of the Third Principal Meridian in Marion County. In the past, Triple T
Trash operated a tire shredding business on the property. According to the attached tax deed, Mr.
Brain C. Bellemey bought the property on January 24, 2002. The attached "Lis Pendens Notice" was
filed on March 10, 2008. This notice indicates that a lawsuit has been filed with Marion County
concerning the property for non-payment of general taxes for the year 2004 and prior.
A previous inspection was conducted at this site on April 2, 2008. An Open Dump Administrative
Citation Warning Notice (ACWN) was sent to the Mr. Bellemey for apparent open dumping
violations. The ACWN listed a July 1, 2008 deadline to remove the waste materials at the site. No
response to the ACWN was received by the Illinois EPA.
Waste materials were observed scattered throughout the property and inside the buildings during the
April 2, 2008 inspection. The majority of the waste materials appeared to have been brought in from
off-site. The waste materials included roofing shingles, damaged dimensional lumber, broken
concrete, bricks, 200+ used tires, unidentified 55-gallon drums, scrap metal, carpeting, a freezer, a
couch, clothing, chairs, a boat, railroad ties, siding, insulation, telephone poles, and miscellaneous
debris. The waste materials are illustrated in the thirty-seven photographs taken during the April 2,
2008 inspection.
During the April 2, 2008 inspection, Mr. Chris Cahnovsky, DLPC/FOS Collinsville Regional
Manager and I spoke to Mr. Atchinson where he indicated that he was interested in buying the
property. Mr. Atchinson also indicated that he wanted to demolish the metal building at the site.
During the inspection, Mr. Cahnovsky explained the proper notification required for the demolition.
In addition, the notification information was sent to Mr. Atchinson in an April 10, 2008 letter. A
copy of the April 2, 2008 inspection report was enclosed with the letter.

On July 23, 2008, I spoke to Mr. Glammeyer upon arrival at the site. He and another unidentified
gentleman were loading scrap metal into a pickup truck. Mr. Glammeyer explained that he is Mr.
Ron Atchinson's cousin and is assisting in the cleanup of the site. I gave Mr. Glammeyer my
business card and requested that Mr. Atchinson call me to discuss the site.
During the July 23, 2008 inspection, I observed that the metal building adjacent to the large concrete
building has been removed from the site sometime after the previous inspection on April 2, 2008 (see
attached photos #001 and #007). The property owner or operator failed to submit to the Illinois EPA
the required 10-day notification of demolition and renovation form for the removal of the metal
building. The site will be referred to the Illinois EPA's Bureau of Air for possible enforcement
action.
The removal of the metal building was the only significant change observed at the site. The
remainder of the site appeared unchanged since the April 2, 2008 inspection. The waste materials
near the building are shown in the attached photos #001 through #004. The waste materials included
used tires, damaged dimensional lumber, broken concrete, and siding. The attached photo #005
shows the drums in the small metal shed adjacent to the east wall of the building. The drums were
also observed during the previous inspection on April 2, 2008. The attached photo #006 illustrate
the damaged dimensional lumber, railroad ties, concrete blocks, siding, and insulation near the
concrete structure on the eastern half of the site. The waste materials observed at the site appeared
unchanged since the previous inspection on April 2, 2008.
A site sketch and copies of digital photographs are attached to this narrative for the DLPC/Division
File. Copies of the photographs will be provided to the property owner or operator upon request.
