HEARING OFFICER ORDER
On August 7, 2008, all parties participated in a telephonic status conference with
the hearing officer. The parties agreed that the respondent has not complied with the
discovery order. The complainant represented that it is reviewing financial ability to pay
documents. The complainant anticipates that the review will be completed prior to the
next status conference. The respondent noted that a supplemental environmental
proposal may be forthcoming.
The respondent’s attorney represented that he anticipates filing a notice of
withdraw if the matter is not settled.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on September 11, 2008, at 1:30 p.m. The
telephonic status conference must be initiated by the complainant, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties
must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing.
