JURISDICTION
This Administrative Citation is issued pursuant to authority vested in the Illinois
Environmental Protection Agency by 415 ILCS 5/1
et. seq.
(2006), specifically 415 ILCS
5/31.1.
FACTS
1.
The Respondent, Alvin Valdez, is the present owner and occupant and in control and
possession of a facility located in the County of Jackson, State of Illinois.
2.
The Respondent, Ruben J. Valdez, upon information and belief, is Alvin Valdez's
father and is in control and possession and an occupant of a facility located in the County of
Jackson, Illinois.
3.
The facility is an open dump, operating without an Illinois Environmental Protection
Agency Operating Permit, and designated with the Site Code # 0778035022. The facility is
known to the Agency as the DeSoto/Alvin Valdez site.
4.
The Respondents have owned, occupied, controlled and/or operated the facility at
all relevant times hereto.

 
5. On June 25, 2008, Don Terry, Field Inspector, Jackson County Health Department,
inspected the facility. A true and correct copy of the inspection report, along with Mr. Terry's
affidavit, are attached and incorporated herein by reference as Exhibit A.
VIOLATIONS
On the basis of Field Inspector, Don Terry's, direct observation, he has determined that
the Respondents have caused or allowed open dumping at the above described facility in a
manner that resulted in the following violations:
That on June 25, 2008, an on-site inspection of the facility disclosed the following:
1.
The Respondents have caused or allowed litter at the facility in violation of 415 ILCS
5/21(p)(1).
2.
The Respondents have caused or allowed the deposition of general construction or
demolition; or clean construction or demolition debris in violation of 415 ILCS 5121(p)(7).
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2006), Respondents
are subject to a civil penalty of One Thousand Five Hundred Dollars ($1,500.00) for each of
the violations identified above, for a total of Three Thousand Dollars ($3,000.00). If
Respondents elect not to petition the Illinois Pollution Control Board, the statutory civil penalty
specified above shall be due and payable no later than September 1, 2008, unless otherwise
provided by order of the Illinois Pollution Control Board.
If Respondents elect to contest this Administrative Citation by petitioning the Illinois
Pollution Control Board in accordance with Section 31.1 of the Act, 415 ILCS 5/31.1 (2006),
and if the Illinois Pollution Control Board issues a finding of violation as alleged herein, after
an adjudicatory hearing, Respondents shall be assessed the associated hearing costs

 
incurred by the Illinois Environmental Protection Agency and the Illinois Pollution Control
Board. Those hearing costs shall be assessed in addition to the Fifteen Hundred Dollars
($1,500.00) statutory civil penalty for each violation.
Pursuant to Section 31.1(d)(1) of the Act, 415 ILCS 5/31.1(d)(1) (2006), if
Respondents fail to petition or elect not to petition the Illinois Pollution Control Board for review
of this Administrative Citation within thirty-five (35) days of the date of service, the Illinois
Pollution Control Board shall adopt a final order, which shall include this Administrative
Citation and findings of violation as alleged herein, and shall impose the statutory civil penalty
specified above.
When payment is made, checks shall be made payable in equal amounts (50% of total
penalty each) to:
(1)
County of Jackson, c/o Jackson County Treasurer, Jackson County Courthouse,
Murphsyboro, Illinois 62966; and
(2)
Illinois Environmental Protection Trust Fund and mailed to the attention of Fiscal
Services, Illinois Environmental Protection Agency, 1021 North Grand Avenue East, P.O. Box
19276, Springfield, Illinois 62794-9276.
Respondents shall complete and return the enclosed Remittance Forms with payments
to ensure proper documentation of payment.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order
of the Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be
assessed against the Respondents from the date payment is due up to and including the date
that payment is received. The Complainant may either initiate proceedings against

Respondents in Circuit Court or other debt collection actions to collect said penalty and/or
hearing costs, plus any interest accrued.

GENERAL REMARKS
During the stated date and time, I conducted an inspection of the site listed above. This inspection
was made as a follow up to an inspection conducted on January 9, 2007 during which open
dumping violations were observed. Weather conditions at the time of the inspection were: partly
cloudy with moderate southwest winds and a temperature of approximately 93°F. I was
accompanied on this inspection by Bart Hagston of the Jackson County Health Department.
According to the Jackson County Assessor's Office, the site is owned by Alvin Valdez. Also, on
January 31, 2006 this inspector and Bart Hagston of the Jackson County Health Department met
at the site with site's operator, Mr. Reuben Valdez (father of site owner, Alvin Valdez) to discuss
ways to bring the site into compliance. During this field visit, Mr. Valdez was asked if he or his son
were operating an automobile parts or automobile salvage business given the large number of
vehicles at the site. Mr. Valdez said that they were not operating any automobile business and all
of the vehicles were for their personal use. He also said that he had brought some of the vehicles
to Illinois from North Dakota.
I arrived at the site and exited my vehicle. I shouted out in a loud voice several times to announce
my presence and to determine if anyone was at the site. I received no response, so I began my
inspection.
I walked to a location west of the building at the site (Area
A on Site Sketch).
In this area I
observed between thirty and forty abandoned vehicles
(Photos #1 - #8, Site Sketch Area A).
Several observations led this inspector to conclude that these vehicles were abandoned. These
observations included: 1) vegetation was growing undisturbed, around and through the vehicles in
this area, indicating that they had not been moved in at least seven days
(Photos #3 -#4 & #6
-
#8, Site Sketch Area A),
2) several trucks had waste material lying in their beds, uncovered and
exposed to the elements
(Photos #1 - #2 & #5 - #8, Site Sketch Area A),
3) no vehicles displayed
current Illinois license plates
(Two of which are shown in Photos #3 - #4, Site Sketch Area A),
and 4) some of the vehicles were missing or had broken windows, allowing their interiors to be
exposed to weathering. Also at the time of the inspection, these vehicles were not in use, were
not useable in their current condition and were not stored in such a way as to protect any future
use. Also, they were stored in an unorganized and unsightly manner.

As previously stated, I observed uncovered waste in the beds of many of the trucks located in the
area labeled "A" on the site sketch
(Photos #1 - #2 & #5 - #8, Site Sketch Area A).
The waste in
these vehicles included, but was not limited to: waste tires, scrap metal, vehicle parts, particle
board that was falling apart, probably due to exposure to precipitation
(Photo #6, Site Sketch
Area A),
dimensional lumber, an off-road recreational vehicle, and plastic items
(Photos #1 - #8,
Site Sketch Area A).
North of the Area A, I observed several more abandoned vehicles
(Photos #9 - #12, Site Sketch).
At the time of the inspection, these vehicles were not in use, were not useable in their current
condition and were not stored in such a way as to protect any future use. Also, they were stored in
an unorganized and unsightly manner.
I continued walking north and observed an area where metal siding and other scrap metal had
been open dumped
(Photo #13, Site Sketch).
The materials in this area were over grown with
vegetation, were not in use and were not stored in such a manner as to protect them for future
use. Also these materials were stored in an unsightly manner.
I continued walking north and observed another area where waste had been open dumped
(Photos #13 - #20, Site Sketch Area
B).
The waste in this area consisted of but was not limited
to: abandoned vehicles, dimensional lumber, lawn mowers, vehicle parts, scrap metal, plastic
items, and roofing shingles. The following observations led this inspector to conclude that the
vehicles in this area were abandoned: 1) there were no tracks in the bare soil that would indicate
the vehicles had been moved recently and 2) none of the vehicles were displaying current Illinois
licence plates.
I walked south and observed another area of open dumped waste
(Photos #20
&
#21, Site
Sketch).
The waste in this area consisted of, but was not limited to: dimensional lumber, scrap
metal, plastic items, a gas powered garden tiller and a motor boat. At the time of the inspection,
these items were not in use, were not useable in their current condition and were not stored in
such a way as to protect any future use.
I then walked south to an area south of the truck trailers and observed two abandoned vehicles
(Photo #22, Site Sketch).
These vehicles appeared abandoned for the following reasons:
1) neither vehicle was displaying a current Illinois licence plate, 2) both vehicles were surrounded
by vegetation that was at least 12 inches high and 3) I observed no tracks through the tall
vegetation that would indicate the vehicles had been moved recently
(Photo #22, Site Sketch).
The total volume of waste observed at this site was approximately 350 cubic yards.
My inspection ended at approximately 1:52 p.m.

During the inspection waste that had been open
dumped and that caused litter and the deposition of general construction or demolition debris was
observed.

At the time of this inspection, this office had no record from the
Illinois Environmental Protection Agency (IEPA), indicating that the site owner had been issued a
permit to conduct a waste-storage, waste-treatment or waste-disposal operation.
Item #6(21)(d)(2): Conduct any waste-storage, waste-treatment, or waste-disposal
operation: In violation of any regulations or standards adopted by the Board:
During the
inspection, violations of regulations and standards adopted by the Board were observed. The
violations included, but were not limited to: lack of adequate cover and lack of litter control.
Item #7(21)(e): Dispose, treat, store, or abandon any waste, or transport any waste into the
State at/to sites not meeting requirements of the Act:
At the time of the inspection, this office
had not received from IEPA documentation that this site had met the requirements of the Act for
landfills. During the inspection, waste that had been disposed of at this site was observed.
