JURISDICTION
This Administrative Citation is issued pursuant to authority vested in the Illinois
Environmental Protection Agency by 415 ILCS 5/1
et. seq.
(2006), specifically 415 ILCS
5/31.1.
FACTS
1.
The Respondent, Dan Kimmel, is the present owner and occupant and in control and
possession of a facility located in the County of Jackson, State of Illinois.
2.
The facility is an open dump, operating without an Illinois Environmental Protection
Agency Operating Permit, and designated with the Site Code # 0778035009. The facility is
known to the Agency as the DeSoto/Dan Kimmel site.
3.
The Respondent has owned, occupied, controlled and/or operated the facility at all
relevant times hereto.
4.
On July 8, 2008, Don Terry, Field Inspector, Jackson County Health Department,
inspected the facility. A true and correct copy of the inspection report, along with Mr. Terry's
affidavit, are attached and incorporated herein by reference as Exhibit A.

 
5. The Respondent had been previouslyfound to have violated §21(p)(1) of the Illinois
Environmental Protection Act, 415 ILCS 5/21(p)(1)(2006) at this site on November 6, 2006
in AC 06-21.
VIOLATIONS
On the basis of Field Inspector, Don Terry's, direct observation, he has determined that
the Respondent has caused or allowed open dumping at the above described facility in a
manner that resulted in the following violations:
That on July 8, 2008, an on-site inspection of the facility disclosed the following:
1. The Respondent has caused or allowed litter at the facility in violation of 415 ILCS
5/21(p)(1).
2. The Respondent has caused or allowed the deposition of general construction or
demolition debris; or clean construction or demolition debris in violation of 415 ILCS
5/21(p)(7).
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2006), Respondent
is subject to a civil penalty of One Thousand Five Hundred Dollars ($1,500.00) for the
§21(p)(7) violation and Three Thousand Dollars ($3,000.00) for the §21(p)(1) violation
because the latter is a second violation for the same offense, for a total of Four Thousand Five
Hundred Dollars ($4,500.00). If Respondent elects not to petition the Illinois Pollution Control
Board, the statutory civil penalty specified above shall be due and payable no later than
September 1, 2008, unless otherwise provided by order of the Illinois Pollution Control Board.
If Respondent elects to contest this Administrative Citation by petitioning the Illinois
Pollution Control Board in accordance with Section 31.1 of the Act, 415 ILCS 5/31.1 (2006),

 
and if the Illinois Pollution Control Board issues a finding of violation as alleged herein, after
an adjudicatory hearing, Respondent shall be assessed the associated hearing costs incurred
by the Illinois Environmental Protection Agency and the Illinois Pollution Control Board. Those
hearing costs shall be assessed in addition to the civil penalty fine stated above.
Pursuant to Section 31.1(d)(1) of the Act, 415 I LCS 5/31.1(d)(1) (2006), if Respondent
fails to petition or elect not to petition the Illinois Pollution Control Board for review of this
Administrative Citation within thirty-five (35) days of the date of service, the Illinois Pollution
Control Board shall adopt a final order, which shall include this Administrative Citation and
findings of violation as alleged herein, and shall impose the statutory civil penalty specified
above.
When payment is made, checks shall be made payable in equal amounts (50% of total
penalty each) to:
County of Jackson, c/o Jackson County Treasurer, Jackson County Courthouse,
Murphsyboro, Illinois 62966; and
(2)?
Illinois Environmental Protection Trust Fund and mailed to the attention of Fiscal
Services, Illinois Environmental Protection Agency, 1021 North Grand Avenue East, P.O. Box
19276, Springfield, Illinois 62794-9276.
Respondent shall complete and return the enclosed Remittance Forms with payments
to ensure proper documentation of payment.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order
of the Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be
assessed against the Respondent from the date payment is due up to and including the date
that payment is received. The Complainant may either initiate proceedings against

 
Respondent in Circuit Court or other debt collection actions to collect said penalty and/or
hearing costs, plus any interest accrued.

You have the right to contest this Citation, pursuant to 415 ILCS 5/31.1. If you elect to
contest this Citation, you must file a Petition For Review with the Clerk of the Illinois Pollution

State's Attorney, Jackson County Courthouse, Third Floor, Murphysboro, 1162966.

Affiant is a field inspector employed by Jackson County Health Department and
has been so employed at all times pertinent hereto.

On July 8, 2008, between the hours of 1:52 p.m. and 2:20 p.m., Affiant conducted
an inspection of the open dump site known as De Soto / Dan Kimmel, Jackson
County, Illinois.
3.
Affiant inspected said open dump site by an on-site inspection.
4.
As a result of the activities referred to in Paragraphs 2 and 3 above, Affiant
completed the Inspection Report form attached hereto and made a part hereof,
which, to the best of Affiant's knowledge and belief, is an accurate representation

GENERAL REMARKS
During the stated date and time, I conducted an inspection of the site listed above. This inspection
was made as a follow up to an inspection conducted on December 7, 2005 during which open
dumping violations were observed. Weather conditions at the time of the inspection were: partly
cloudy skies with moderate winds and a temperature of approximately 90°F. I was accompanied
on this inspection by Bad Hagston of the Jackson County Health Department.
According to the Jackson County Assessor's Office, the site is owned by Dan Kimmel.
Prior to the inspection, I had arranged to meet Mr. Kimmel at the site at 2:00 p.m. Upon arrival, I
observed Mr. Kimmel and two other adult males working on a piece of equipment. Mr. Kimmel
joined me and I began the inspection.
I walked north along a mowed path west of the residence

A). In this area I
observed open dumped waste
(Photos #1 - #11, Site Sketch Area
A). The waste in this area
included, but was not limited to: metal barrels, dimensional lumber, parts of a fiberglass garage
door, abandoned vehicles, pickup truck bed tops, an abandoned camper, scrap metal, a truck
trailer with part of its side missing, a mobile home lying on its side and other items too numerous to
list
(Photos #1 - #11, Site Sketch Area A).
I walked east to a location marked "B" on the site sketch. In this area I observed more open
dumped waste scattered about

In this area, I observed
open dumped waste that included, but was not limited to: scrap metal, abandoned vehicles (a car
and a school bus), vehicle parts, plumbing fixtures, metal shelving, furniture, PVC pipe, plastic
items, metal gas cylinders, a truck trailer open at both ends and other materials too numerous to
list
(Photos #12 - #20, Site Sketch Area B).
I then walked to a location on the site marked "C" on the site sketch. In this area I observed open
dumped waste scattered about. The waste I observed in this area included, but was not limited to:
metal gas cylinders, plastic items, scrap metal, plywood, dimensional lumber, glass windows and
other items too numerous to list

At the time of the inspection, the items observed at the site were not in use and were not stored in
such a way as to protect any future use. The items observed were also stored in an unsightly
manner and were generally over grown with vegetation which would seem to indicate that the
materials had not been used at least during this current growing season

The total volume of waste observed was approximately 645 cubic yards.
My inspection ended at approximately 2:20 p.m.

Illinois Environmental Protection Agency (IEPA), documentation that the site owner had obtained a
