JURISDICTION
This Administrative Citation is issued pursuant to the authority vested in the Illinois
Environmental Protection Agency by Section 31.1 of the Illinois Environmental Protection Act, 415
ILCS 5/31.1 (2006).
FACTS
1.
That Donald and Mary Jennings are the present owners and operators of a facility
located at the last property with structures on the east side of the road, prior to agricultural fields and
a 90 degree curve on South Buckhorn Street, which runs north/south on the west side of the City of
Mt. Sterling, Brown County, Illinois. The property is commonly known to the Illinois Environmental
Protection Agency as Mt. Sterling/Jennings, Donald and Mary.
2.
That said facility is an open dump operating without an Illinois Environmental
Protection Agency Operating Permit and is designated with Site Code No.0090105031.
3.
That Respondents have owned and operated said facility at all times pertinent hereto.
4.
That on May 30, 2008, William Zierath of the Illinois Environmental Protection
Agency's Springfield Regional Office inspected the above-described facility. A copy of the

inspection report setting forth the results of said inspection is attached hereto and made a part
hereof.
VIOLATIONS
Based upon direct observations made by William Zierath during the course of his May 30,
2008 inspection of the above-named facility, the Illinois Environmental Protection Agency has
determined that Respondents have violated the Illinois Environmental Protection Act (hereinafter,
the "Act") as follows:
(1) That Respondents caused or allowed the open dumping of waste in a manner
resulting in litter, a violation of Section 21(p)(1) of the Act, 415 ILCS 5/21(p)(1)
(2006).
CIVIL PENALTY
On June 2, 2005, the Board found Donald E. and Mary A. Jennings in violation of Section
21(p)(1) of the Act in AC 05-67.
Because this Administrative Citation addresses a second or subsequent violation of Section
21(p)(1) of the Act, pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2006),
Respondents are subject to a civil penalty of Three Thousand Dollars ($3,000.00) for each violation,
for a total of Three Thousand Dollars ($3,000.00). If Respondents elect not to petition the Illinois
Pollution Control Board, the statutory civil penalty specified above shall be due and payable no later
than August 15, 2008, unless otherwise provided by order of the Illinois Pollution Control Board.
If Respondents elect to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31.1 of the Act, 415 ILCS 5/31.1 (2006), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondents shall be assessed the associated hearing costs incurred by the Illinois Environmental

Protection Agency and the Illinois Pollution Control Board. Those hearing costs shall be assessed
in addition to the One Thousand Five Hundred Dollar ($1,500.00) statutory civil penalty for each
violation.
Pursuant to Section 31.1(d)(1) of the Act, 415 ILCS 5/31.1(d)(1) (2006), if Respondents fail
to petition or elect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and findings of violation as
alleged herein, and shall impose the statutory civil penalty specified above.
When payment is made, Respondents' check shall be made payable to the Illinois
Environmental Protection Trust Fund and mailed to the attention of Fiscal Services, Illinois
Environmental Protection Agency, 1021North Grand Avenue East, P.O. Box 19276, Springfield,
Illinois 62794-9276. Along with payment, Respondents shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of the
Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondents from the date payment is due up to and including the date that payment is
received. The Office of the Illinois Attorney General may be requested to initiate proceedings
against Respondents in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued.

ADMINISTRATIVE CITATION
Respondents have the right to contest this Administrative Citation pursuant to and in
accordance with Section 31.1 of the Act, 415 ILCS 5/31/1 (2006). If Respondents elect to contest
this Administrative Citation, then Respondents shall file a Petition for Review, including a Notice of
Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois Pollution Control
Board, State of Illinois Center, 100 West Randolph, Suite 11-500, Chicago, Illinois 60601. A copy of
said Petition for Review shall be filed with the Illinois Environmental Protection Agency's Division of
Legal Counsel at 1021 North Grand Avenue East, P.O. Box 19276, Springfield, Illinois 62794-9276.
Section 31.1 of the Act provides that any Petition for Review shall be filed within thirty-five (35) days
of the date of service of this Administrative Citation or the Illinois Pollution Control Board shall enter
a default judgment against the Respondent.

Affiant, William Zierath, being first duly sworn, voluntarily deposes and states as
follow:
1.
Affiant is a field inspector employed by the Land Pollution Control
Division of the Environmental Protection Agency and has been so
employed at all times pertinent hereto.
2.
On May 30, 2008, between 12:40 PM and 1:05 PM, Affiant conducted
an inspection of a disposal site operated without an Agency permit, located
in Brown County, Illinois and known as Jennings, Donald and Mary by the
Illinois Environmental Protection Agency. Said site has been assigned site
code number LPC# 0090105031 by the Agency.
3.
Affiant inspected said Jennings, Donald and Mary open dump site by
an on-site inspection which included walking and photographing the site.
4.
As a result of the activities referred to in paragraph 3 above, Affiant
completed the Inspection Report form attached hereto and made a part
hereof, which, to the best of Affiant's knowledge and belief, is an accurate
representation of Affiant's observations and factual conclusions with
respect to said Jennings, Donald and Mary open dump.

A complaint investigation was conducted at this lot in the southwest part of Mt. Sterling
on May 30, 2008. No one else was present during this investigation. The weather was
cloudy and 75°F.
It was not known until after this complaint investigation that this lot had been the site of a
previous complaint investigation. The property was first inspected on July 7, 2004. An
Administrative Citation Warning Notice, dated September 8, 2004, was sent to Mr. and
Mrs. Jennings. Mr. and Mrs. Jennings did respond to the ACWN. During November 18,
2004 and March 10, 2005 re-inspections, it was determined that clean up had not been
completed. An Administrative Citation was issued on April 18, 2005 for a violation of
Section 21(p)(1) of the Illinois Environmental Protection Act. No petition for review was
received for the Administrative Citation. Without a petition for review, the Illinois
Pollution Control Board ordered the respondents to pay the $1500 fine. During a May 18,
2005 follow up inspection, the site was found to have returned to compliance. This was
reflected in a June 22, 2005 RTC letter.
The anonymous complaint was not very specific about the location of the complaint. It
said there were two lots "full of garbage, rubbish, old cars, weeds, wood, General
rubbish." This was the only lot in the general location with apparent violations observed
from the public road.
While there was no one else at this site during this investigation, someone driving a dark
green minivan stopped along Buckhorn Road and sat there for several minutes. Due to
glare on the windows, I was unable to see who was in the minivan. I started to approach
the minivan, but the minivan drove off before I got very near.
From Buckhorn Road, there were several vehicles surrounded by dumpsters, roll-off
boxes and junk. The view from Buckhorn Road is shown in photographs
009010503105302008-001, 009010503105302008-002 and 009010503105302008-
003.

 
There was a packer truck parked near the east end of the site. The name on the door of the
truck indicated that it belonged to Mark Jennings. Tape on the door obscured the word
"Bros." below the name Jennings. It was unclear whether the truck was operable. The
packer truck did not contain garbage. This truck is shown in photographs
0090105031-05302008-004, 0090105031-05302008-005, 009010503105302008-006
and 0090105031-05302008-010.
There were two dumpsters located behind the packer truck. These dumpsters contained
household refuse, a small amount of demolition waste, and other junk. These dumpsters
are shown in photographs 009010503105302008-007, 0090105031-05302008-008 and
009010503105302008-010.
There was another dumpster located south of the packer truck. This dumpster is shown in
photograph 009010503105302008-009. There was a considerable amount of junk
around the dumpster. The junk around this dumpster included a plastic 5-gallom bucket
(with about an inch of water in it), an empty 55-gallon drum, plastic items, scrap metal
and burned wire. The wastes around this dumpster are shown in photographs
009010503105302008-009, 009010503105302008-012, 0090105031-05302008-014,
009010503105302008-015 and 009010503105302008-016.
The waste in the dumpster shown in photograph 0090105031-05302008-009 included
electronic equipment, small appliances, paper, cloth, and unidentified plastic and metal
objects. This waste is also shown in photographs 009010503105302008-009 and
0090105031-05302008-013.
There was one old stove in the east end of the site. The old stove is shown in photograph
0090105031-05302008-011.
There was an abandoned pickup truck with the bed filled with waste along the south edge
of this site. Wastes included numerous old glass soda bottles, scrap metal and scrap
plastic. The truck did not have any license plates. The right rear tire was either flat or
sunk far into the soil and had been that way for long enough that weeds had grown up
around the truck during the previous growing season. The waste in the bed is shown in
photographs 009010503105302008-017 and 009010503105302008-019. The rear of
the truck (including the place where the rear license plate should have been) is shown in
photograph 009010503105302008-018. The right, rear tire is shown in photograph
009010503105302008-019.
There was an empty 55-gallon drum located northwest of the pickup truck. This 55-
gallon drum is shown in photograph 009010503105302008-020.
In front of the packer truck was another dumpster. The dumpster had a roll of chain link
fence sitting on it. The wastes in the dumpster included plastic, paper, cardboard and
metal. This dumpster is shown in photographs 009010503105302008-021 and
0090105031-05302008-022.

 
There was a pile of junk including metal shelves, the remnants of a metal tank, an air
conditioner, 2 tires on rims, old toys, and unidentifiable plastic and metal items west of
the pickup truck described above. This junk is shown in photographs
0090105031-05302008-024, 009010503105302008-025, 009010503105302008-026,
009010503105302008-027, 0090105031-05302008-030 and 0090105031-05302008-
031 .
Also along the south edge of the site was an abandoned flatbed truck with scrap metal on
the bed. The waste is shown in photograph 0090105031-05302008-028. The license
plate without a current sticker is shown in photograph 0090105031-M5302008-029.
There was an old metal door and other junk located north of the flatbed truck. This waste
is shown in photograph 009010503105302008-032.
There was a trailer loaded mostly with scrap metal in the central part of the site. The
trailer is shown in photograph 009010503105302008-033. The waste in this trailer is
also shown in photographs 009010503105302008-037 and 009010503105302008-038.
There was an abandoned automobile in the central part of the site. This abandoned
automobile is shown in photograph 0090105031-05302008-034. The license plate with
an expired sticker (from 1988) is shown in photograph 009010503105302008-035.
There was a roll-off box with one of the long sides removed on the site. This roll-off was
being used to store scrap metal and other junk. This roll-off box is shown in photograph
009010503105302008-036.
The area south of the building was being used for storing an assol
?
merit of junk, including
scrap metal, lawn furniture, tires (off rims), windows, tools, and an old grill, insulated
wire and bathroom fixtures. This waste is shown in photographs 009010503105302008-
039, 0090105031-05302008-040, 0090105031-05302008-041, 009010503105302008-
042, 0090105031-05302008-043 and 0090105031-M5302008-044.
West of the building was an assortment of junk. There was a dilapidated trailer filled with
old windows and other junk. This trailer is shown in photograph 009010503105302008-
045. There was an abandoned automobile. The abandoned automobile is shown in
photographs 0090105031-M5302008-045, 0090105031-05302008-046 and
0090105031-05302008-047. There were used tires on rims in this area. These used tires
are shown in photographs 0090105031-05302008-045 and 0090105031-05302008-046.
In addition to these large items, there were numerous scattered small items, including
