HEARING OFFICER ORDER
On July 17, 2008, all parties participated in a telephonic status conference with
the hearing officer. Discussion centered on filing dates for any pre-hearing motions and
a pre-hearing status report. It was agreed that the parties pre-hearing status reports are
due to be filed on or before August 18, 2008. The mailbox rule will not apply. The
parties were instructed to include an exhibit list and a witness list in the report, as well as
the issues to be addressed at the hearing, scheduled for October 20 through the 23, 2008.
A pre-hearing motion cut-off date was set for September 18, 2008. The pre-hearing
motion cut-off date may have to be revisited should an issue arise.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on August 21, 2008, at 10:30 a.m. The
telephonic conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the conference, the parties must be prepared to
discuss the status of the above-captioned matter and potential hearing dates.
