HEARING OFFICER ORDER
On July 16, 2008, all parties participated in a telephonic status conference with the
hearing officer. The petitioner represented that it is reviewing a draft permit application that was
forwarded by the respondent. The parties represented that they anticipate a telephonic
conference with the respondent’s permit section on July 22 or 23, 2008, in an attempt to resolve
questions regarding the draft. To that end, it was agreed that the record is now due to be filed on
or before August 11, 2008. The petitioner represented that it will file an additional waiver of the
statutory decision deadline to and including November 6, 2008.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on August 7, 2008, at 10:30 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
