JURISDICTION
This Administrative Citation is issued pursuant to authority vested in the Illinois
Environmental Protection Agency by 415 ILCS 5/1 et
seq.
(2006), specifically 415 ILCS
5/31.1.
FACTS
1.
The Respondent, Lester Johnson, is the present owner and in control and
possession of a facility located in the County of Jackson, State of Illinois.
2.
The respondent, Arthur Cross, is the occupant and in control and possession of a
facility located in the County of Jackson, State of Illinois.
3.
The facility is an open dump, operating without an Illinois Environmental Protection
Agency Operating Permit, and designated with the Site Code # 0778145021. The facility is
known to the Agency as the Murphysboro/Lester Johnson site.
4.
The Respondents have owned, occupied, controlled and/or operated the facility at
all relevant times hereto.

5.
On June 5, 2008, Don Terry, Field Inspector, Jackson County Health Department,
inspected the facility. A true and correct copy of the inspection report, along with Mr. Terry's
affidavit, are attached and incorporated herein by reference as Exhibit A.
VIOLATIONS
On the basis of Field Inspector, Don Terry's, direct observation, he has determined that
the Respondents have caused or allowed open dumping at the above described facility in a
manner that resulted in the following violations:
That on June 5, 2008, an on-site inspection of the facility disclosed the following:
1.
The Respondents have caused or allowed litter at the facility in violation of 415 ILCS
5/21(p)(1).
2.
The Respondents have caused or allowed open burning at the facility in violation of
415 ILCS 5/21(p)(3).
3.
The Respondents have caused or allowed the deposition of waste in standing or
flowing waters in violation of 415 ILCS 5/21(p)(4).
4.
The Respondents have caused or allowed the deposition of general construction or
demolition; or clean construction or demolition debris in violation of 415 ILCS 5121(p)(7).
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 4151LCS 5/42(b)(4-5) (2006), Respondents
are subject to a civil penalty of One Thousand Five Hundred Dollars ($1,500.00) for each of
the violations identified above, for a total of Six Thousand Dollars ($6,000.00). If Respondents
elect not to petition the Illinois Pollution Control Board, the statutory civil penalty specified
above shall be due and payable no later than August 15, 2008, unless otherwise provided by

order of the Illinois Pollution Control Board.
If Respondents elect to contest this Administrative Citation by petitioning the Illinois
Pollution Control Board in accordance with Section 31.1 of the Act, 415 I LCS 5/31.1 (2006),
and if the Illinois Pollution Control Board issues a finding of violation as alleged herein, after
an adjudicatory hearing, Respondents shall be assessed the associated hearing costs
incurred by the Illinois Environmental Protection Agency and the Illinois Pollution Control
Board. Those hearing costs shall be assessed in addition to the Fifteen Hundred Dollars
($1,500.00) statutory civil penalty for each violation.
Pursuant to Section 31.1(d)(1) of the Act, 415 ILCS 5/31.1(d)(1) (2006), if
Respondents fail to petition or elect not to petition the Illinois Pollution Control Board for review
of this Administrative Citation within thirty-five (35) days of the date of service, the Illinois
Pollution Control Board shall adopt a final order, which shall include this Administrative
Citation and findings of violation as alleged herein, and shall impose the statutory civil penalty
specified above.
When payment is made, checks shall be made payable in equal amounts (50% of total
penalty each) to:
(1)
County of Jackson, do Jackson County Treasurer, Jackson County Courthouse,
Murphsyboro, Illinois 62966; and
(2)
Illinois Environmental Protection Trust Fund and mailed to the attention of Fiscal
Services, Illinois Environmental Protection Agency, 1021 North Grand Avenue East, P.O. Box
19276, Springfield, Illinois 62794-9276.

Respondents shall complete and return the enclosed Remittance Forms with payments
to ensure proper documentation of payment.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order
of the Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be
assessed against the Respondents from the date payment is due up to and including the date
that payment is received. The Complainant may either initiate proceedings against
Respondents in Circuit Court or other debt collection actions to collect said penalty and/or
hearing costs, plus any interest accrued.

You have the right to contest this Citation, pursuant to 415 ILCS 5/31.1. If you elect to
contest this Citation, you must file a Petition For Review with the Clerk of the Illinois Pollution

has been so employed at all times pertinent hereto.

On June 5, 2008, between the hours of 9:35 a.m. and 9:55 a.m., Affiant conducted
an inspection of the open dump site known as Murphysboro / Lester Johnson,
Jackson County, Illinois.

Affiant inspected said open dump site by an on-site inspection.

GENERAL REMARKS
During the stated date and time, I conducted an inspection of the site listed above. This inspection
was made as a follow up to a complaint received by this office which stated that a double wide
mobile home had been torn down and burned at the site with a bulldozer having been used in the
process. Weather conditions at the time of the inspection were: cloudy with moderate winds and
a temperature of approximately 80°F. I was accompanied on this inspection by Steve Williams of
the Jackson County Health Department.
According to the Jackson County Assessor's Office, the site is owned by Lester Johnson.
I arrived at the site and from Town Creek Road, a public roadway, observed two mobile home
frames to the south

and a cleared area where I observed a
bulldozer and what appeared to be general construction or demolition debris lying on the ground
(Photo #2, Site Sketch-Area
A). I drove onto the site and from a location on the driveway, I
observed the cleared area I had observed from the road. From my current location I observed
general construction or demolition debris open dumped on the ground as well as the bulldozer
described by the complainant

A). Later, after the inspection, Mr.
Williams told me that he had been to this site on April 1, 2008 to perform a private sewage system
inspection and on that date, he observed a double wide mobile home at the site, located in the
general location marked "X" on the site sketch.
At this point I drove to the Cross residence. I observed a large dog near the porch of the
residence, so I remained in the vehicle and honked the horn several times. No one responded, so
I drove south on the driveway to Mr. Johnson's residence. I honked the horn of the vehicle several
times, again with no response. I then drove back to the area where the bulldozer was parked to
begin my inspection.
I left my vehicle and walked east in the area marked "Area A" on the site sketch. My first
observation
was that
the
soil had been recently disturbed in this area

A). I also observed open dumped waste in this area that included, but was not
limited to: ash, dimensional lumber, scrap metal, coated electrical wire, broken concrete, plywood,
fiberglass insulation, cloth, a metal barrel, plastic items, metal pipe and rail road ties

Several observations led this inspector to conclude that waste was not only burned at this location
but was also buried on site. First, the following observations led me to conclude that waste had
been burned at this site: 1) I observed ash and charred dimensional lumber scattered about in the
area labeled "A" on the site sketch

A) and 2) I observed
leaves of several trees in the approximate center of the area labeled "A" on the site sketch were
dead as if they had been subjected to some type of stress, such as high temperatures
(Photos #3

A) and 3) I observed that limbs and bark on these trees appeared
darkened, as if they had been charred or coated with ash and or soot. I observed that only a
limited number of branches of a few trees had dying leaves, while the rest of the branches on
those same trees as well as surrounding trees showed no signs of leaf death.
Second, the following observations led me to conclude that waste had been buried at this site:
1) I observed that the soil in the entire area labeled "A" on the site sketch had been disturbed

A), 2) I observed partially buried waste in several
locations in the area labeled "A" on the site sketch

A), 3) I observed an area where a trench had been dug and waste had been placed into the trench
which was then partially covered with soil

A) and 4) the area
directly in front of the bulldozer appeared to have been dug out and waste in that area was
partially covered with soil

I then proceeded to a location on the north side of Town Creek and in an area labeled "B" on the
site sketch, I observed two mobile home frames, scrap metal, dimensional lumber and other waste
not readily identifiable open dumped

The material in
this area was not in use, not usable in its current condition and was not being stored for future use.
This material was also being stored in an unsightly manner.
I then observed to my north, waste that had been open dumped into Town Creek (Photo #16, Site
Sketch-Area A). The waste in this area consisted of, but was not limited to: carpeting, plywood
and dimensional lumber. This waste had been open dumped into flowing waters of the State.
Most of the open dumped waste I observed at this site appeared to be general construction or
demolition debris, which would seem to verify the complainant's description that a mobile home
had been demolished and burned at this location. Also, at no time during this inspection did I

Burning: During the inspection evidence of the open dumping of waste that resulted in open
burning and which caused, threatened or allowed air pollution in Illinois was observed.
Item #3(12)(a): Cause, threaten or allow water pollution in Illinois; Item #4(12)(d): Create a
water pollution hazard; Item #8(211(p)(4): Cause or allow the open dumping of any waste in
a manner which results in any of the following occurrences at the dump site: (4) Deposition
of waste in standing or flowing waters: During the inspection, the open dumping of waste that
resulted in the deposition of waste in standing or flowing waters and which caused, threatened or
allowed water pollution in Illinois was observed.
