HEARING OFFICER ORDER
On July 8, 2008, all parties participated in a telephonic status conference with the
hearing officer. The Illinois Environmental Protection Agency (Agency) filed its
recommendation on June 23, 2008. The Agency recommended that the Board deny
petitioner’s request. The petitioner represented that it does not intend to file a response,
and requested that a hearing date be scheduled.
To that end, a hearing in the above-captioned matter has been scheduled for
August 20, 2008. The time and location will be noted in a notice of hearing. A pre-
hearing briefing schedule was discussed and it was agreed that petitioner must file its pre-
filed testimony on or before August 1, 2008. The Agency’s response is due to be filed on
or before August 6, 2008. The mailbox rule will not apply to either filing.
The parties or their legal representatives are directed to participate in a telephonic
pre-hearing conference with the hearing officer on August 7, 2008, at 10:00 a.m. The
telephonic conference must be initiated by the petitioner, but each party is nonetheless
responsible for its own appearance. At the conference, the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
