HEARING OFFICER ORDER
On June 26, 2008, all parties appeared at a telephonic status conference with the hearing
officer. The complainant represented that progress is being achieved in its attempt to narrow the
issues, but that the “55
th
sewer issue” remains a concern and is attempting to schedule a meeting
with a third-party to discuss further. The attorney for the Village of Hinsdale represented that it
is proceeding on track to forward a draft of a wet weather construction permit to the Illinois
Environmental Protection Agency for its review. Complainant continues to review all data
forwarded to it from the respective respondents. Both the complainant and respondent DuPage
County may seek to add another party to the above-captioned proceedings. Settlement
negotiations continue with respondent Metropolitan Water Reclamation District of Greater
Chicago, Illinois, with a meeting scheduled for the middle of July 2008. It was agreed that the
telephonic status conference be continued to the date and time noted below.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on September 11, 2008, at 10:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. The complainant represented that it will notify the parties and the hearing
officer of a call-in number prior to the next telephonic status conference. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matter and
their readiness for hearing.
