    NOTICE
    OF OPEN WAIVER OF nO-DAY DECISION DEADLINE..
    Petitioner, JOYCE FARMS ("Joyce Farms"), by its undersigned counsel,
    pursuant to 35 Illinois Administrative Code ยง101.308(c)(1), hereby agrees to an open
    waiver of the statutory 120-day decision deadline for final action by the Illinois Pollution
    Control Board ("Board") in the above-captioned proceeding. In support of this Notice,
    the Petitioner states as follows:
    1. On March 4, 2008, Petitioner filed a Request for a Ninety Day Extension of
    Appeal Period.
    2. On March 5, 2008, Respondent also filed a Request for a Ninety Day
    Extension of Appeal Period.
    3. On March 20,2008, the Board extended the appeal period until June 2,2008.
    4. On June 2, 2008, Petitioner filed a Petition for Review of Illinois
    Environmental Protection Agency Decision which the Board accepted on June
    5,2008.
    5. Petitioner and Respondent are currently involved in settlement discussions
    that may lead to the resolution of all issues pending in this matter.

    6. Petitioner hereby voluntarily agrees to an open waiver of the statutory 120-
    day decision deadline in order
    to conduct settlement negotiations in this
    matter.
    WHEREFORE,

    of the statutory 120-day decision deadline for final action on Petitioner's
    Petition for Review
    of Illinois Environmental Protection Agency Decision.
