HEARING OFFICER ORDER
On June 19, 2008, all parties participated in a telephonic status conference with
the hearing officer. The complainant represented that the parties are still discussing the
possibility of settlement and that documents are being exchanged regarding economic
benefit analysis.
On June 5, 2008, the parties submitted an agreed discovery schedule. The
discovery schedule is accepted to the extent as follows. All written discovery must be
served by the parties on or before August 1, 2008. All responses to written discovery
must be served on or before September 5, 2008. Depositions of lay or fact witnesses
must be completed on or before October 10, 2008. Requests to admit must be served on
or before October 31, 2008. Requests for disclosure of expert witnesses must be served
on or before October 31, 2008. Written expert witness disclosures must be served on or
before December 5, 2008. All dispositive motions must be filed on or before March 20,
2009.
The parties or their legal representatives are directed to participate in a telephonic
status conference on September 11, 2008, at 11:30 a.m. The status conference must be
initiated by the petitioner, but each party is nonetheless responsible for its own
appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a stipulation and
proposal for settlement is filed prior to the next status conference, the conference will be
cancelled without further notice.
