HEARING OFFICER ORDER
Post-Hearing Comments
The second hearing in this proceeding took place Wednesday, June 4, 2008, in Chicago.
The Board received the transcript of that second hearing (Tr. 2) on Tuesday, June 10, 2008, and
posted it to its Web site at
www.ipcb.state.il.us
on Wednesday, June 11, 2008.
Under Section 102.108(b) of the Board's procedural rules, "[a]ny person may submit
written comments on any proposal within 14 days after the receipt of the hearing transcript in
Board offices unless otherwise specified by the hearing officer or the Board." 35 III. Adm. Code
102.108(b). Any participant in this proceeding who wishes to file a post-hearing comment with
the Board is directed to do so on or before Friday, July 11, 2008.

Notice List
In an order dated February 13, 2008, the hearing officer stated that the Board would
begin this proceeding by including in the Notice List each of approximately 600 potentially
affected manufacturers listed in Appendix A to the Technical Support Document filed by the
Illinois Environmental Protection Agency (Agency). The Board mailed a copy of that February
13, 2008, hearing officer order and notice of hearings to each of those entities. However, the
order stated that the Board would mail copies of subsequent opinions and orders only to those
who specifically indicated that they wished to remain on the Notice List. The Board received
this indication from approximately 40 entities, and participants can view the current Notice List
through COOL.

After the Board mailed a copy of the February 13, 2008 hearing officer order and notice
of hearings to each of those entities listed by the Agency, the U.S. Postal Service returned
approximately 70 envelopes marked variously "Vacant," "Forwarding Order Expired,"
"Addressee Unknown," "Attempted – Not Known," "Moved – Left No Address," and other
similar indications that mail delivery failed. In order to clarify the record in this proceeding,
Attachment A to this order contains the names and addresses of the approximately 70 entities
from which the U.S. Post Office returned the Board's February 13, 2008 notice of hearings and
hearing officer order.
