JURISDICTION
This Administrative Citation is issued pursuant to the authority vested in the Illinois
Environmental Protection Agency by Section 31.1 of the Illinois Environmental Protection Act , 415
ILCS 5/31.1 (2006).
FACTS
1.
That Upper Rock Island County Landfill, Inc. is the permitted owner and operator,
and Dave Geier is the certified operator in responsible charge (collectively "Respondents") of a
facility located at 17201 20" Avenue, North, Rock Island, Rock Island County Illinois.
2.
That said facility is a sanitary landfill, operating under Illinois Environmental
Protection Agency Permit No. 1995-008-LF, and is designated with Site Code No. 1618100014.
The facility is commonly known to the Illinois Environmental Protection Agency as
Upper Rock Island County Landfill.
3.
That Respondents have owned/operated said facility at all times pertinent hereto.

4. That on April 22, 2008, Ronald E. Mehalic of the Illinois Environmental Protection
Agency's Peoria Regional Office inspected the above-referenced facility. A copy of his inspection
report setting forth the results of said inspection is attached hereto and made a part hereof.
VIOLATIONS
Based upon direct observations made by Ronald E. Mehalic during the course of his April
22, 2008 inspection of the above-referenced facility, the Illinois Environmental Protection Agency
has determined that Respondents violated the Illinois Environmental Protection Act (hereinafter, the
"Act") as follows:
(1)
That Respondents conducted a sanitary landfill in a manner which resulted in uncovered
refuse remaining from the previous operating day or at the conclusion of any operating
day, a violation of Section 21(o)(5) of the Act, 415 ILCS 5/21 (o)(5) (2006).
(2)
That Respondents conducted a sanitary landfill in a manner which resulted in failure to
collect and contain litter by the end of each operating day, a violation of Section
21(o)(12) of the Act, 415 ILCS 5/21 (o)(12) (2006).
CIVIL PENALTY
Pursuant to Section 42(b)(4) of the Act, 415 ILCS 5/42(b)(4) (2006), Respondents are
subject to a civil penalty of Five Hundred Dollars ($500.00) for each of the violations identified
above, for a total of One Thousand Dollars ($1,000.00). If Respondents elect not to petition the
Illinois Pollution Control Board, the statutory civil penalty specified above shall be due and payable
no later than July 15, 2008, unless otherwise provided by order of the Illinois Pollution Control
Board.

If Respondents elect to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31.1 of the Act, 415 ILCS 5/31.1 (2006), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondents shall be assessed the associated hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board. Those hearing costs shall be assessed
in addition to the statutory civil penalty.
Pursuant to Section 31.1(d)(1) of the Act, 415 ILCS 5/31.1(d)(1) (2006), if Respondents fail
to petition or elect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and a finding of violation as
alleged herein, and shall impose the statutory civil penalty specified above.
When payment is made, Respondents' check shall be made payable to the Illinois
Environmental Protection Trust Fund and mailed to the attention of Fiscal Services, Illinois
Environmental Protection Agency, 1021 North Grand Avenue East, P.O. Box 19276, Springfield,
Illinois 62794-9276. Along with payment, Respondents shall complete and retum the enclosed
Remittance Form to ensure proper documentation of payment.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of
the Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondents from the date payment is due up to and including the date that payment is
received. The Office of the Illinois Attorney General may be requested to initiate proceedings
against Respondents in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued.

PROCEDURE FOR CONTESTING THIS
ADMINISTRATIVE CITATION
Respondents have the right to contest this Administrative Citation pursuant to and in
accordance with Section 31.1 of the Act, 415 ILCS 5/31/1 (2006). If Respondents elect to contest
this Administrative Citation, then Respondents shall file a signed Petition for Review, including a
Notice of Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois
Pollution Control Board, State of Illinois Center, 100 West Randolph, Suite 11-500, Chicago, Illinois
60601. A copy of said Petition for Review shall be filed with the Illinois Environmental Protection
Agency's Division of Legal Counsel at 1021 North Grand Avenue East, P.O. Box 19276, Springfield,
Illinois 62794-9276. Section 31.1 of the Act provides that any Petition for Review shall be filed
within thirty-five (35) days of the date of service of this Administrative Citation or the Illinois Pollution
Control Board shall enter a default judgment against the Respondents.

voluntarily deposes and states as follows:
1.
Affiant is a field inspector employed by the Land
Pollution Control Division of the Illinois Environmental
Protection Agency and has been so employed at all times
pertinent hereto.
2.
On April 22, 2008, between 5:05 A.M. and 8:30 A.M.,
Affiant conducted an inspection of the sanitary landfill in Rock
Island County, Illinois, known as Upper Rock Island County
Landfill, Illinois Environmental Protection Agency Site No.
1618100014, operating under IEPA Permit #1995-008-LF.
3.
Affiant inspected said Upper Rock Island County
Landfill site by an on-site inspection, which included walking
the site and interviewing personnel.
4.
Before and/or after said inspection of said landfill
site, Affiant reviewed Illinois Environmental Protection Agency
permits issued to the subject site and investigated into whether

 
or not required documents were timely filed on behalf of the
subject site.

As a result of the activities referred to in
Paragraphs 3 and 4 above, Affiant completed the Inspection Report
form attached hereto and made a part hereof, which, to the best
of Affiant's knowledge and belief, is an accurate representation
of Affiant's observations and factual conclusions with respect
to Upper Rock Island County Landfill.

Narrative
On April 22 2008,
I (Ronald Mehalic) conducted a solid waste inspection, permitted compost
inspection, and complaint investigations from 5:05 a.m. to 8:30 a.m. at Upper Rock Island
County Landfill (1618100014) in Rock Island County. The facility was granted a Significant
Modification Permit (1995-008-LF) to develop and operate a new municipal and non-hazardous
special waste landfill. Subsequent permit modification requests have been submitted and
approved. The latest permit modification #65 (Log No. 2007-396) was recently approved by the
Agency in an April 11, 2008 permit approval letter. On December 13, 2004, the Agency
received a significant modification permit renewal application (Log 2004-450) for Permit No.
1995-008-LF. The permit renewal was granted in an August 9, 2005 permit letter. The
expiration date for Permit No. 1995-008-LF is March 15, 2010.
I arrived at the facility at 5:05 a.m. and found the front gate locked (photograph 1). At 5:25 a.m.
a facility employee arrived and opened the front gate. Once opened, I proceeded to the previous
day's active working area. On the way to the active area I inspected the citizen drop off area.
Photograph 2 shows the roll off box and haul truck at the citizen drop of area. Photograph 3
shows plastic, cardboard, and paper inside the facility's Material Recovery Facility. The
building only handles recyclable materials (i.e., plastic, cardboard, and paper) prior to return to
the commercial market. The plastic, cardboard, and paper are collected from recycling bins
around the area and transported to Resource Management, Inc., in Naperville, Illinois for
recycling. No solid waste is collected, placed in, and separated inside the building.
Photographs 4, 5, 6, and 7 show the previous day's active area in Cell 4B (see Figure 1). Poly
tarp fabric was observed as the cover material placed on the waste at this area. Further
inspection of Fill Areas 4B and 4C revealed uncovered refuse. Photographs 8, 9, 10, 11, 12, 13,
14, 15, 16, 17, 18, 19, 20, 21, and 37 show exposed refuse protruding from inadequate daily
cover over the areas. Photographs 14, 18, and 20 also show litter strewn on and around a pile of
wood chips. Litter was also observed scattered on top of Fill Areas 4B and 4C, and wind blown
against fencing at the northwest corner of the landfill (see photographs 22 & 23). After
inspecting the Cell Areas 4B and 4C I proceeded to the permitted compost area at the facility.
Photograph 24 shows the required sign at the compost facility entrance, compost well CW3 and
upgradient groundwater monitoring well G132 (see compost facility diagram). At this time I met
Monty Thompson, Operations Manager at the compost area. Photographs 25 and 26 show the
previous day's bagged landscape waste and clean source separated wood at the landscape waste
storage area. The facility's approved operating landscape waste compost permit allows the
storage of clean source separated wood at the storage area. The wood is chipped separately from
the landscape waste in the facility's tub grinder and used as alternative daily cover and/or road
base during inclement weather. Photograph 27 shows the tub grinder. Photograph 28 shows
recently ground up landscape waste
that is to be windrowed. Photograph
29 shows two large
windrows at the compost area. The end-product compost is designated in their permit for use as
cover material (daily or final). No end-product compost is offered for sale.

Also conducted during the inspection, were citizen complaint investigations regarding odor and
blowing litter onto a golf course and neighboring properties. I informed Mr. Thompson of the
complaint regarding an alleged odor on a southerly wind of an evening during February. Mr.
Thompson said that he was informed by Mike Knobloch, of the FOS/BOA-Moline, of the odor
issue. Mr. Thompson said he drove along Hubbard Road and did not detect any odor. I spoke
with Mr. Knobloch who informed me that he investigated the odor complaint in February and did
not detect an odor as he drove along Hubbard Road and also at the complainant's property.
Hubbard road is located approximately 'A mile south of the landfill (see attached aerial map).
Photographs 30, 31, 32, and 33 where taken on the Golfinohr Golf Course just north of the
landfill. Photos 30 and 31 also show tall wind fencing that is located on landfill property. See
attached aerial map. Mr. Thompson informed me that last Wednesday the area experienced high
winds. As a result, litter (plastic bags and paper) did blow onto the golf course. The landfill
hired extra people from a temp hiring service and rented a high reach cherry picker (see
photograph 23) to pick up the blown litter on the golf course and trees near and on the golf
course. I did not see any litter from the landfill on the golf course property. Mr. Thompson said
that the crew picked up about seven bags of wind blown trash on the golf course. Photographs
34 and 35 show the landfill's previous day's active area, northern side slope, and movable wind
fencing. The photos where taken from on top of the high earth berm on landfill property. The
photos show litter strewn on the northern side slope. Photograph 36 shows Golfinohr Golf
Course from the earth berm.
Photograph 38 shows leachate extraction well L321. The well is to be decommissioned and
replaced by leachate extraction well L324 at the proposed location of L321R as shown in
figure 1, addendum dated February 28, 2008 to Log No. 2007-396. Photograph 39 shows
leachate recirculation Hub C in the background and the western edge of the covered and
vegetated top of Fill Area 3B. Photographs 40 and 41 show gas extraction wells and portions of
the covered and vegetated top of Fill Areas 3A and 3B.
Photographs 42 and 43 show the permitted concrete leachate load out pad with concrete berm
and the 72,390-gallon leachate tank with concrete secondary containment, ladder, tank heater,
recirculation lines, concrete walls, and electric control panels, and control panel for the telemetry
rely station system. According to manifests reviewed at the facility's office, leachate was last
removed from the landfill on April 16, 2008. On April 16, 2008, a total of 30462 gallons of
leachate was taken to the East Moline Wastewater Treatment Plant for treatment.
Photograph 44 shows the permitted surface water retention basin at the northeastern corner of the
landfill property. Photograph 45 shows a portion of the covered and vegetated northern side
slope at Fill Area 3A.
Photograph 46 shows leachate collection riser L314. Leachate is collected and pumped from this
riser, as well as from leachate risers L313, L312, and L309, via underground transmission lines
to the permitted 72, 390 gallon leachate collection tank for eventual disposal.

Photograph 47 shows the gas to energy plant. The gas developer/contractor is US Energy Biogas
Corp. that operates the installed LFG collection system and also owns the gas and generated
electricity rights. The combustion of landfill gas via Jenbacher engine generators produces
electricity for resale to the local utility. Photographs 48 and 49 show the undeveloped south
expansion unit.
After visually inspecting the previous day's active area, the developed features of the landfill,
and the adjoining property, Mr. Thompson and I proceeded to the landfill office. Reviewed at
the facility's office were recently filed load checking sheets, alternative daily cover records,
asbestos disposal log, special waste disposal log, monthly and annual gas sampling results,
leachate disposal records, daily waste placement logs, and daily operational sheets. All records
reviewed appeared to be in order.
Also reviewed were the facility's permitted compost records. Compost records reviewed were
the load checking logs, personnel training, operating record, and weekly windrow monitoring
data (i.e., temperature, moisture, & oxygen levels). All records reviewed appeared to be in order.
The facility was granted Permit No. 2002-306-OP, approving the operation of a landscape waste
composting facility. According to records reviewed, the windrows were last turned on April 14,
2008. On August 1, 2007, Modification No. 1 to permit 2002-306-OP was granted to the facility
renewing the permit to operate. The permit is to expire on August 1, 2012.
While reviewing records, Mr. Thompson called Dave Geier, Chief Operator for the facility. We
discussed the uncovered refuse, litter, and the blowing litter onto the golf course last Wednesday.
Mr. Geier said that the facility will most likely initiate a policy that will shut down waste filling
operations on days with heavy winds. When winds near 30 mph, the facility will shut down in
order to prevent the likelihood of litter blowing off site.
After the landfill inspection, I proceeded to Golfmohr Golf Course on Hubbard Road. A steady
rain began to fall as I drove toward Hubbard Road. At the golf course and along Hubbard Road
near the golf course I did not observe any litter that would be considered wind blown from the
landfill. The landfill is approximately 1/2 mile from Hubbard Road (see attached aerial map).
A review of the Upper Rock Island County Landfill's groundwater file at the Peoria Regional
office revealed that the facility is electronically submitting their groundwater data within the
permitted timeframes.
As a result of having uncovered refuse from any previous operating day and failing to collect and
contain litter from the site by the end of any previous operating day, the following alleged
violations were checked on the attached 811 Solid Waste Landfill Inspection Checklist:
1. Pursuant to Section 21(d)(1) of
the
Act, in relevant part, no person shall conduct any
waste-storage, waste-treatment, or waste-disposal operation without a permit granted by
the Agency or in violation of any conditions imposed by such permit, including periodic
reports and full access to adequate records and the inspection of facilities, as may be

necessary to assure compliance with this Act and with regulations and standards adopted
there under.
A violation of Section 21(d)(1) of the [Illinois] Environmental Protection Act (415 ILCS
5/21(d)(1)) is alleged for the following reason:

was observed in violation of the following conditions in Section II of Permit 1995-
008-LF, Modification #65:
Condition 2(e) in Section II: The operator of this solid waste facility shall not
conduct the operation in a manner which results in any of the following: uncovered
refuse remaining from any previous operating day or at the conclusion of any
operating day, unless authorized by permit.
Condition 2(1) in Section II: The operator of this solid waste facility shall not
conduct the operation in a manner which results in any of the following: failure to
collect and contain litter from the site by the end of each operating day.
Condition 4(a) in Section II: At the end of each day of operation all exposed waste
shall be covered with: Clean soil at least six (6) inches thick (i.e., conventional daily
cover).
Condition 5(d) in Section II: Materials listed in Special Condition 4(b) through (j)
above are approved alternative daily covers pursuant to 35 III. Adm. Code,
811.106(b) and 812.111(b). Their use as daily cover shall be subject to the following
conditions: Conventional daily cover in accordance with 35 III. Adm. Code
811.106(a) shall be used if weather or other conditions adversely affect the ability of
the alternative daily cover to prevent problems with blowing liter, fire, odors, and
vectors.
2.
Pursuant to Section 21(d)(2) of the Act, no person shall conduct any waste-storage,
waste-treatment, or waste-disposal operation in violation of any regulations or standards
adopted by the Board under this Act.
A violation of Section 21(d)(2) of the [Illinois] Environmental Protection Act (415 ILCS
5/21(d)(2)) is alleged for the following reason:

was observed in violation of Sections 811.106(a) and 811.107(k) of the Regulations.
3.
Pursuant to Section 21(e) of the Act, no person shall dispose, treat, store or abandon any
waste, or transport any waste into this State for disposal, treatment, storage or
abandonment, except at a site or facility which meets the requirements of this Act and of
regulations and standards there under.

not meet the requirements of the Act and regulations thereunder.
4.
Pursuant to Section 21(o)(5) of the Act, no person shall conduct a sanitary landfill
operation which is required to have a permit under subsection (d) of this Section, in a
manner which results in uncovered refuse remaining from any previous operating day or
at the conclusion of any operating day, unless authorized by permit.
A violation of Section 21(o)(5) of the [Illinois] Environmental Protection Act (415 ILCS
5/21(o)(5)) is alleged for the following reason:
Uncovered refuse was observed at the
Upper Rock Island County Landfill.
5.
Pursuant to Section 21(o)(12) of the Act, no person shall conduct a sanitary landfill
operation which is required to have a permit under subsection (d) of this Section, in a
manner which results in failure to collect and contain litter from the site by the end of
each operating day.
A violation of Section 21(o)(12) of the [Illinois] Environmental Protection Act (415 ILCS
5/21(o)(12)) is alleged for the following reason:

failed to contain litter from the site by the end of the previous operating day.
6.
Pursuant to 35 Ill. Adm. Code 811.106(a), a uniform layer of at least 0.15 meter (six
inches) of clean soil material shall be placed on all exposed waste by the end of each day
of operation.
A violation of 35 Ill. Adm. Code 811.106(a) is alleged for the following reason:
Uncovered refuse was observed at the Upper Rock Island County Landfill.
7.
Pursuant to 35 III. Adm. Code 811.107(k), the operator shall patrol the facility daily to
check for litter accumulation. All litter shall be collected and placed in the fill or in a
secure, covered container for later disposal. The facility shall not accept solid waste from
vehicles that do not utilize devices such as covers or tarpaulins to control litter, unless the
nature of the solid waste load is such that it cannot cause any litter during its
transportation to the facility.
A violation of 35 Ill. Adm. Code 811.107(k) is alleged for the following reason:
Upper
Rock Island County Landfill failed to contain litter from the site by the end of the
previous operating day.
