HEARING OFFICER ORDER
On March 18, 2008, CITGO Petroleum Corporation (CITGO) and PDV Midwest
Refining, L.L.C. (PDV) (collectively, petitioners) filed a petition for an adjusted standard
(Pet.). PDV owns and CITGO operates a petroleum refinery located at 135
th
Street and
New Avenue in Lemont, Will County (Refinery). Specifically, petitioners seek an
adjusted standard from the Board’s ammonia nitrogen discharge standards.

On May 7, 2008, the Illinois Environmental Protection Agency (Agency) filed a
Motion for Extension of Time to File Recommendation.

Ill. Adm. Code 104.416(a).
Specifically, the Agency sought to extend by 30 days to June 5, 2008, the deadline by
which to file its recommendation. In an order dated May 15, 2008, the Board accepted
petitioners petition for hearing and granted the Agency’s motion for extension of time to
file its recommendation.
On May 30, 2008, the Agency filed a motion for Extension of Time to File
Recommendation Mot.).

35 Ill. Adm. Code 104.416(a). Specifically, the Agency
seeks to extend by 14 days to June 20, 2008, the deadline by which to file its
recommendation. Counsel for the Agency states that he requests additional time to file
the Agency’s recommendation because of extenuating circumstances of his workload.
Mot. at 2. In an affidavit attached to the motion, counsel for the Agency states that he
has contacted counsel for petitioners regarding the requested extension and that “CITGO
does not object to an additional fourteen (14) days time to file this Recommendation in
this matter.” Mot. (Affidavit of Sanjay K. Sofat).
The hearing officer grants the Agency’s motion and extends to June 20, 2008, the
deadline by which the Agency is to file its recommendation. Petitioners “may file a
response to the recommendation within 14 days after the date of service of the
recommendation.” 35 Ill. Adm. Code 104.406(d).
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on June 12, 2008, at 11:00 a.m. The telephonic
status conference must be initiated by the petitioner, but each party is nonetheless

responsible for its own appearance. At the conference, the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
