HEARING OFFICER ORDER
On May 23, 2008, the parties informed the hearing officer that it appears they
have reached a resolution in this matter without the necessity of a hearing. Further
discussions and documents will be exchanged. Once resolved, the petitioner anticipates
filing a voluntary motion to dismiss. The petitioner represented that it will file an
additional waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on September 4, 2008, at 10:00 a.m. The
telephonic status conference must be initiated by the petitioner, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties
must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing. If, however, a motion to dismiss is filed prior to the next status conference,
the conference will be cancelled without further notice.
