HEARING OFFICER ORDER
On May 22, 2008, all parties participated in a telephonic status conference with the
hearing officer. The petitioner represented that it wants to move forward because a draft permit
has not been forthcoming and requested that the respondent file the record in the above-
captioned matter. To that end, the record is due to be filed on or before June 23, 2008. The
respondent represented that the permit application is in line to be reviewed. Petitioner also
represented that it will file an additional waiver of the statutory decision deadline to and
including October 2, 2008. At the next status conference, hearing dates will be discussed.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on June 26, 2008, at 11:45 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
