HEARING OFFICER ORDER
On Wednesday, April 23, 2008, prior to the start of hearing in Des Plaines, a prehearing
conference was held pursuant to 35 Ill. Adm. Code 102.404. The participants discussed hearing
dates and how best to organize the remaining hearings. The participants agreed to begin with the
use designations for the Chicago Area Waterways System (CAWS) to be followed by the use
designations for the lower Des Plaines River. This organization will include testimony on
recreational use designations for the two areas. Prefiling deadlines were also discussed and those
were tentatively set for August 4, 2008, for prefiled testimony and August 25, 2008, for prefiled
questions.
Today hearings are set in September. The hearings will be continued day-to-day until
business is concluded. If there are questions and testimony remaining at the close of business on

September 10, 2008, hearings may be resumed on September 23, 2008, and continue on
September 24 and 25, 2008.
When the testimony and questioning on use designations are completed, additional
hearing dates to hear testimony on the water quality standards will be scheduled. Participants
should be prepared to discuss additional hearing dates at that time.
Testimony must be prefiled by August 4, 2008 and the mailbox rule does not apply.
Prefiled questions must be filed by August 25, 2008 and the mailbox rule does not apply. If
these deadlines cannot be met, a motion must be filed with the hearing officer explaining why
and how long an extension is being sought. Any motion to extend these prefiling deadlines must
be filed prior to these deadlines and any response is to be filed within seven (7) days of receipt,
to avoid undue delay in this proceeding.
All filings in this proceeding will be available on the Board's web page at
www.ipch.statc.il.us and participants may file electronically on the Board's web page. The
prefiled testimony and questions must be served on the persons on the service list, except it is not
necessary to serve the hearing officer with the prefiled testimony and questions for these
hearings.
