HEARING OFFICER ORDER
On May 8, 2008, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that discussions continue and that it appears they
have reached a resolve. It is anticipated that the re-issuance of the construction permit
will be achieved prior to the next telephonic status conference. If the permit is re-issued,
the petitioner represented that it would file a motion to voluntarily dismiss the above-
captioned appeal. To that end, and by agreement, the respondent’s record in the above-
captioned matter is now due on or before June 13, 2008.
The parties or their legal representatives are directed to participate in a telephonic
status conference on May 29, 2008, at 9:00 a.m. The status conference must be initiated
by the petitioner, but each party is nonetheless responsible for its own appearance. At the
status conference, the parties must be prepared to discuss the status of the above-
captioned matter and their readiness for hearing.
