HEARING OFFICER ORDER
On May 8, 2008, all parties participated in a telephonic status conference with the
hearing officer. Discussion centered on scheduling a hearing in these matters for the
week of September 8, 2008 or the following week. These dates were discussed at the
prior telephonic status conference on March 5, 2008. The respondent represented that it
would not be available for either of those two weeks due to various conflicts with either
the witness or counsel. The respondent was directed to file a status regarding the
unavailability of counsel or witnesses for a hearing attempting to be scheduled 4 months
in the future. In the status report, the respondent may again address whether it would be
available for either of those proposed weeks in September 2008. The due date for the
written status report is due to be filed on or before May 22, 2008.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on May 29, 2008, at 10:00 a.m. The telephonic
conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the conference, the parties must be prepared to
discuss the status of the above-captioned matter and potential hearing dates.
