HEARING OFFICER ORDER
On Wednesday, April 23, 2008, prior to the start of hearing in Des Plaines, a prehearing
conference was held pursuant to 35 Ill. Adm. Code 102.404. At that conference, a member of
the regulated community requested that the rulemaking be stayed. The hearing officer, after a
discussion on the request, indicated that the Board would rule on any motions to stay, not the
hearing officer. Thus, any motion to stay must be filed with the Board.
The participants conferred on tentative hearing dates of June 16, September 8-10, 16-18,
and 23-25, 2008. The participants then discussed how best to organize the remaining hearings.
The participants agreed to begin with the use designations for the Chicago Area Waterways
System (CAWS) to be followed by the use designations for the lower Des Plaines River. This
organization will include testimony on recreational use designations for the two areas.
Prefiling deadlines were also discussed and those were tentatively set for August 4, 2008
for testimony and August 25, 2008, for prefiled questions. Based on this tentative schedule and
organization, hearing dates will be set some time in the next few weeks to conform with this
agreed upon schedule.
