HEARING OFFICER ORDER
On April 24, 2008, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that the United States Environmental Protection Agency
has yet to rule on the related confidentiality issues.
The Board on November 15, 2007, granted the parties’ joint motion to stay the above-
captioned matter to and including April 17, 2008. In light of the expiration of the Board’s stay
order, the parties requested that the status conference be continued so that they may discuss how
to proceed with this matter, including the possibility of submitting a proposed discovery
schedule.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on May 8, 2008, at 2:00 p.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
