    ORDER OF THE BOARD (by G.T. Girard):
    On April 3, 2008, the parties timely filed a request to extend the 35-day period within
    which Ameren Energy Generating Company (Ameren) may appeal a February 29, 2008
    beneficial use determination of the Illinois Environmental Protection Agency (Agency).

    ILCS 5/3.135, 40(a)(1) (2006); 35 Ill. Adm. Code 105.206. The Agency’s determination
    concerns coal combustion by-product (CCB) produced from the combustion of coal used in
    generating electricity at Ameren’s Meredosia Power Station in Morgan County. The Agency
    granted a beneficial use determination, subject to conditions, for CCB to be used as structural fill
    in the construction of three roads at the facility.
    The Board extends the appeal period until July 6, 2008, as the parties request.

    that date, the Board will dismiss this case and close the docket.
