This language directly follows the federal language of corresponding 40 C.F.R. 264.1101(c)(4). The antecedent to "it must
inspect and record in the facility's operating record" is "data gathered from monitoring equipment and leak detection
equipment, as well as the containment building and the area immediately surrounding the containment building, to detect
signs of releases of hazardous waste." Using the words "it must inspect the record" would inpermissibly shift the meaning of
the original USEPA provision. What may be confusing is the intervening new alternative language relating to members of
the Fast Track Program.
The following change in the language, which primarily involves moving that language relating to the Fast Track Program to
the end of the provision for inclusion as an exception to the general requirement, would require less effort to read clearly:
"It must inspect and record in the facility's operating record, at least once every seven days, data gathered from monitoring
equipment and leak detection equipment, as well as the containment building and the area immediately surrounding the
containment building, to detect signs of releases of hazardous waste, except that the owner or operator of a Performance
Track member facility must inspect the record at least once each month after approval by the Agency."
