HEARING OFFICER ORDER
On April 10, 2008, a telephonic status conference was held. Respondent Felker
Pharmacy, Inc. and Third-Party respondents did not appear. The complainant represented that
there appears to be a settlement as to all parties, and will draft a stipulation and proposal for
settlement (stipulation) and circulate for review. By agreement, all outstanding answers are now
due to be filed on or before July 11, 2008. Representatives for the Third-Party respondents are
directed to file their appearances.
The parties or their legal representatives are directed to appear at a telephonic status
conference with the hearing officer on June 19, 2008, at 9:30 a.m. The telephonic conference
must be initiated by the complainant, but each party is nonetheless responsible for its own
appearance. At the conference the parties must be prepared to discuss the status of the above-
captioned matter and their readiness for hearing. If, however, a stipulation is filed prior to the
next status conference, the conference will be cancelled without further notice.
