The Illinois Environmental Protection Agency ("Illinois EPA") hereby files its
Recommendation pursuant to Section 125.204 of the regulations of the Illinois Pollution
Control Board, 35 Ill. Adm. Code 125.204.

number TC-08-07, Exhibit A) for an Illinois EPA recommendation regarding the
tax certification of water pollution control facilities pursuant to 35 Ill. Adm. Code
125.204.

proposed water pollution control facilities in this request are located at
N1/2
of the NW 1/4 of Section 24, T15N, R7E of the 3rd PM in Bureau County,
at the above
street address and consist of the following:
Livestock waste management facilities consisting of one concrete pit (51 ft. x
391 ft. x 8 ft. deep) with ten concrete pump out pits (each 4 ft. x 4 ft. x 8 ft. deep)
and the portion of the concrete slotted flooring over the manure pit in one swine
building.
These livestock waste management facilities are used to collect, transport and/or
store livestock wastes prior to cropland application, and are further described in
Exhibit A.

Section 11-10 of the Property Tax Code, 35 ILCS 200/11-10 (2006), defines
"pollution control facilities" as:
"any system, method, construction, device or appliance appurtenant
thereto or any portion of any building or equipment, that is designed,
constructed, installed or operated for the primary purpose of: (a)
eliminating, preventing, or reducing air or water pollution ...or (b)
treating, pretreating, modifying or disposing of any potential solid, liquid
or gaseous pollutant which if released without treatment, pretreatment
modification or disposal might be harmful, detrimental or offensive to
human, plant or animal life, or to property."

Pollution control facilities are entitled to preferential tax treatment, 35 ILCS
200/11-5.

Based on the infounation in the application and the purpose of the facilities, it is
the Illinois EPA's engineering judgment that the described facilities may be
considered "pollution control facilities," pursuant to 35 Ill. Adm. Code
125.200(a), with the primary purpose of eliminating, preventing, or reducing
water pollution, or as otherwise provided in 35 Ill. Adm. Code 125.200, and are
eligible for tax certification from the Board.
WHEREFORE, the Illinois EPA recommends that the Board issue the

The Bureau of Water received a request on March 26, 2007 from Ehnle Farms for an Illinois EPA
recommendation regarding the tax certification of water pollution control facilities pursuant to 35 II.
Adm. Code 125.204. We offer the following recommendation.
The water pollution control facilities in this request include the following:

section, and therefore eligible for tax certification from the Illinois Pollution Control Board. The Bureau
of Water therefore recommends that the Board issue the requested tax certification for these facilities.

Gary Ehnle Comprehensive Nutrient Management Plan
Gary operates a confinement swine facility & a small cow-calf herd. There is one finishing
unit now that holds 2400 head of swine with another unit proposed to be constructed this
fall or next year. The existing swine finishing building is 51' X 391' with a 8' deep pit. The
proposed new finishing unit will be the same size. The existing swine nursery on the main
farmstead will not be used after the new finishing unit is built. There is approximately 30
head of cows that are
maintained annually. The cows are held in two
units. A barn 40' X
40' with a concrete slab 40' X 60' on the south side and a Feeder unit 140' X 40'with a
concrete slab 16' X 140' with a 2000 gal catch basin. The outside concrete lots will be
scraped & dry stacked daily as needed. The barns will be guttered, along with the barn
adjacent to the composting area. Manure will be scrap & piled in a dry stack undercover
in a pin in the end of the barns. The cows are only in the barns two months (Feb-Mar) of
the year. In the spring they are put on a 60 acre pasture until after harvest, at which
time
they are then pastured on cornstalks. Calculations for manure storage for the cows was
based on no more than 1 month storage (drystacked) and then spread on the field.
Gary will spread the liquid swine manure himself with a unit that will inject it into the soil.
He will follow the instruction provided for calibrating the applicator. He will also use the
guidelines enclosed for taking & testing manure samples each time the pits are unloaded.
Gary has 520 acres he can inject manure on. His soil types are predominately Piano silt
loam, 2-5%; Waukegan silt loam, 2-5%; & Elburn silt loam, 0-2%. He uses conservation
tillage usually no-till to plant his crops. He has established many grassed waterways on all
his farms plus uses a 100' grassed buffer strip between Coal Creek and his cropland.
He
will establish an additional 100' nonspreadable
crop buffer zone where noted on the
cropland map.
He uses composting to handle any dead animals. This will amount to approximately 480#
per week. Wood chips are used to compost Compost is spread on cropland when dead
animas are completely decomposed.
Gary has current soil tests (less than 4 yrs old) on 3.3
acre grids, except for Ike Airport
field which
is do to be retested before manure will be spread in the Fall of 2008. The
existing I' & K is well below levels that would prohibit spreading. There is nutrient plans
developed for the annual manure produced, phis plans for the buffer zone areas along Coal
Creek. The drainage ditch along the east side of the Home farm has high banks which does
not allow surface water to enter from Gary's field.
Soil tests will be taken every four years, application rates adjusted
accordingly. Manure
test will be done annually when the pits are being emptied, with at least three samples
being taken during the unloading process to evaluate nutrient content of the manure.
Equipment will
be calibrated annually
according to the guidelines provided in Ihis plan.
The thy cattle manure will be spread with a conventional manure spreader with no more
than 4 tons/acre being applied. The areas to spread on are also designated in the plan.

 
The swine buildings are inspected daily for water problems suck as broken waterers or
pipes. Ventilation system is also checked to make sure fans are operating correctly. An
alarm system is installed that notifies Gary by phone if any part of the system does not
function properly. The pits are checked for any leaks on a monthly basis by walking
around the building and visually looking for excess seepage. Additional inspection are
made when the pits are emptied in the fall each year.

The liquid swine manure is injected. The facility is more than a 1/4 mile from any
residences. The composting area has adequate wood chips which controls odor very well.
It is turned on a weekly basis and only spread on the field after all decomposition has taken
place.

The Department has received a certification notice from the owner or operator relative to the
conviction of construction of a non-lagoon livestock waste handling structure at the aforementioned
facility. The certification indicates that the waste handling structure has been constructed or modified
in accordance with the requirements of the Livestock Management Facilities Act (Act) (510 ILCS
77/1 et seq.) and rules and that the information provided during the registration process is correct.
On July 5, 2005, Department representatives conducted a final inspection at the
facility pursuant to the
Livestock Management Facilities Act (510 ILCS 77/13 (g)). No deviations from the construction plan
were noted during the inspection. Inspections of the facility were also conducted prior to and during
the construction phase of the project.
Pursuant to the Section 13 of the Livestock Management Facilities Act, the construction plan and
certification requirements of the Act have been met. The owner or operator of the livestock waste
handling facility may proceed to place the structure into service.

on the attached list and owner agrees to take delivery and pay for such items under the terms
listed hereunder. Payment for materials is net and all money for materials is due upon delivery.
Owner agrees to assume all liability for materials (and carry insurance to cover replacement value
of materials) and hereby waives all rights of subrogation under the owner's policy of insurance.
The risk of loss for materials passes to owner upon delivery to owner's premises or building site.
Precision Structures will gather all scrap material in one area. Any excess material and/or
equipment not deemed scrap by Precision Structures remains the property ofPrecision Structures.
It is the owner's responsibility to dispose of that, which is determined to be scrap material by
Precision Structures.
Any concrete work involved pursuant to this agreement is not guaranteed against cracking
or leaking. Reasonable precautions, normal to the swine confinement construction industry, shall
be taken by the contractor, but cracks do frequently occur and cannot be reasonably prevented.
Building and equipment are covered by a 90-day warranty for materials and labor, from
the date animals enter the building and/or the building is deemed complete by Precision
Structures. After 90 days the owner is responsible for all repairs and maintenance. Normal
maintenance is the responsibility of the owner. Building may not be used until Precision
Structures has received all payments. Agreement is considered executed by signature of both
parties.

I just noticed in paragraph 1. of the Recommendation for the above, it should be 2007 (date when IEPA received
the request from the applicant). Arghhhh!!!
