NOW COME the Complainant; DANIEL J. BEERS,
pro se,
and the Respondent, LET IT
SHINE, LLC (incorrectly named
in
the Complaint as DAVE CALHOUN (LET IT SHINE CAR
WASH)),
by his attorney, Peter R. Jennetten, and for their Motion for Relief from Hearing
Requirement pursuant to
§31 of the Illinois Environmental Protection Act, 415 ILCS 5/31 and 35
Ill.
Adm. Code §103.301, state:
I.
The parties have reached an agreement on all outstanding issues in this matter.
2.
This agreement is presented to the Board in a Stipulation and Proposal for Settlement,
filed contemporaneously with this motion.
3.
All parties agree that a hearing on the Stipulation and Proposal for Settlement is not
necessary and respectfully request relief from such a hearing as allowed
by §31 of the Act and
§103.301
of the Code.
WHEREFORE, the Complainant, DANIEL
J. BEERS, and the Respondent, LET

LLC (incorrectly named in the Complaint as
