ORDER OF THE BOARD (by T.E. Johnson):
On October 20, 2004, Robert and Tony Thompson (the Thompsons) filed a petition
asking the Board to review a determination of the Illinois Environmental Protection Agency
(Agency) denying a proposed corrective action plan for the Thompsons’ leaking underground
storage tank site located at 4th and Jefferson in Cairo, Alexander County. In an order of
November 4, 2004, the Board accepted the Thompsons’ petition for hearing. Since then, the
parties have participated in numerous status conferences with the hearing officer, but the case
has not been to hearing.
On March 26, 2008, the Thompsons filed a motion to voluntarily dismiss the appeal. In
the motion, the Thompsons state that the parties have “resolved the issues in dispute.” Motion at
1. The Board grants the motion, dismisses the case, and closes the docket.
