HEARING OFFICER ORDER
On April 1, 2008, the parties participated in a telephone status conference with the
hearing officer. The Agency is now sending the parties portions of the record pertaining to
petitioner’s hearing comments at the Agency proceeding. The parties agree that the entire
Agency record may be filed with the Board as late as April 14, 2008. A hearing remains set for
April 16, 2008. Complainant’s brief is due by May 5, 2008 and respondents’ briefs are due by
May 19, 2008. The mailbox rule will not apply.
The parties are reminded to conduct themselves with decorum, and are further reminded
that the hearing officer may conduct the hearing in the manner in which she deems fit. The
parties may object on the record, but it is inappropriate for parties to tell the hearing officer what
she may and may not say or do at hearing. Any party presuming to do so at hearing will be
admonished on the record.
The parties are directed to participate in a telephone status conference with the hearing
officer at 2:00 p.m. on April 10, 2008. All parties have been provided with a teleconference
number and passcode.
The decision deadline is June 19, 2008.
