HEARING REPORT
On September 4, 2007, Abbott Laboratories (Abbott) filed a proposal for site-specific
rulemaking pursuant to Section 28 of Environmental Protection Act (Act) (415 ILCS 5/28
(2006)), to allow it "additional operational flexibility" with regard to emissions from certain
tunnel dryers and fluid bed dryers at its pharmaceutical manufacturing facility located in
Libertyville Township, Lake County.
Hearing was held in Libertyville on March 7, 2008., beginning at 1:00 p.m. Both the
technical justification and economic impact of the proposed rules were addressed at this hearing..
Abbott, represented by Katherine D. Hodge, presented testimony of Abbott Employees
Diane Beno and Robert C. Wells. The Illinois Environmental Protection Agency (Agency),
represented by Charles Matoesian, presented no testimony. But, the Agency did make available
one of its engineers, Yoginder Mahajan, to answer questions prefiled by the Board in a March 4,
2008 hearing officer order.
No members of the public were present at hearing. Six exhibits were presented at
hearing, as reflected in the exhibit list attached to this order. The hearing officer granted
Abbott's February 29, 2008 motion to amend exhibit 3 as well as its motion to amend its
proposal. Abbott stated that the United States Environmental Protection Agency had asked it to
present to the Agency supporting emissions calculations for baseline years 1999 and 2000 data.
Abbott will submit that data to the Board, as well as to the Agency, at the Agency's specific
request. After consultation with the participants, the hearing officer set May 1, 2008 as the close
of the post hearing comment period, specifically requesting that the Agency file a closing
comment indicating its view of the proposal.
As stated at hearing, the Board will make every effort to expedite ruling on this proposal,
once all closing comments are received. Participants are encouraged to timely submit comments.
