PETITIONER'S MOTION TO VOLUNTARILY WITHDRAW
ITS PETITION FOR NPDES PERMIT APPEAL
NOW COMES the Petitioner, the Metropolitan Water Reclamation District of Greater
Chicago ("District"), by its Attorney, Frederick M. Feldman, and pursuant to 35
III.Admin.Code 101.500, states as follows:
1.
On February
29, 2008,
the District filed a Petition for NPDES Permit Appeal
in connection with the NPDES permit for the District's Lemont Water Reclamation Plant
("Lemont WRP").
2.
On March
21, 2008,
the Illinois Environmental Protection Agency ("IEPA")
issued a modification to the Lemont WRP NPDES Permit.
3.
The issuance of the modification to the Lemont WRP NPDES Permit
essentially moots the issues raised by the District's permit appeal.
4.
Based upon these facts and circumstances, the District has determined that it is
appropriate to withdraw its appeal.

WHEREFORE, the Metropolitan Water Reclamation District of Greater Chicago
respectfully requests the Board to grant the District's Motion to Voluntarily Withdraw its
NPDES Permit Appeal and to enter an Order dismissing the instant permit appeal with
prejudice.
