JURISDICTION
This Administrative Citation is issued pursuant to the authority vested in the Illinois
Environmental Protection Agency by Section 31.1 of the Illinois Environmental Protection Act , 415
ILCS 5/31.1 (2006).
FACTS
1.
That Pike County Landfill, Inc. is the permitted owner and operator and Larry Beard
and Steven Blake are the certified operators (collectively "Respondents") of the Pike County Landfill
located at 32246 375
th Street, Baylis, Pike County, Illinois.
2.
That said facility is operated as a sanitary landfill, operating under Illinois
Environmental Protection Agency Permit No. 1995-155-LF, and is designated with Site Code No.
1498160001. The facility is commonly known to the Illinois Environmental Protection Agency as
New Salem/Pike County Landfill.

That Respondents have owned and/or operated said facility at all times pertinent
hereto.

That on February 7, 2008, Michelle E. Cozadd of the Illinois Environmental
Protection Agency's Springfield Regional Office inspected the above-referenced facility. A copy of
her inspection report setting forth the results of said inspection is attached hereto and made a part
hereof.
VIOLATIONS
Based upon direct observations made by Michelle Cozadd during the course of her February
7, 2008 inspection of the above-referenced facility, the Illinois Environmental Protection Agency has
determined that Respondents violated the Illinois Environmental Protection Act (hereinafter, the
"Act") as follows:
(1) That Respondents conducted a sanitary landfill in a manner which resulted in uncovered
refuse remaining from any previous operating day or at the conclusion of any operating
day, unless authorized by permit, a violation of Section 21 (o)(5) of the Act, 415 ILCS
5/21 (o)(5) (2006).
CIVIL PENALTY
Pursuant to Section 42(b)(4) of the Act, 415 ILCS 5/42(b)(4) (2006), Respondents are
subject to a civil penalty of Five Hundred Dollars ($500.00) for each of the violations identified
above, for a total of Five Hundred Dollars ($500.00). If Respondents elect not to petition the Illinois
Pollution Control Board, the statutory civil penalty specified above shall be due and payable no later
than April 30, 2008, unless otherwise provided by order of the Illinois Pollution Control Board.
If Respondents elect to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31.1 of the Act,
415 ILCS 5/31.1 (2006), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondents shall be assessed the associated hearing costs incurred by the Illinois Environmental

Protection Agency and the Illinois Pollution Control Board. Those hearing costs shall be assessed
in addition to the statutory civil penalty.
Pursuant to Section 31.1(d)(1) of the Act, 415 ILCS 5/31.1(d)(1) (2006), if Respondents fail
to petition or elect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois Pollution Control Board shall
adopt a final order, which shall include this Administrative Citation and a finding of violation as
alleged herein, and shall impose the statutory civil penalty specified above.
When payment is made, Respondents' check shall be made payable to the Illinois
Environmental Protection Trust Fund and mailed to the attention of Fiscal Services, Illinois
Environmental Protection Agency, 1021 North Grand Avenue East, P.O. Box 19276, Springfield,
Illinois 62794-9276. Along with payment, Respondents shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order of
the Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against the Respondents from the date payment is due up to and including the date that payment is
received. The Office of the Illinois Attorney General may be requested to initiate proceedings
against Respondents in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued.

PROCEDURE FOR CONTESTING THIS
ADMINISTRATIVE CITATION
Respondents have the right to contest this Administrative Citation pursuant to and in
accordance with Section 31.1 of the Act, 415 ILCS 5/31/1 (2006). If Respondents elect to contest
this Administrative Citation, then Respondents shall file a signed Petition for Review, including a
Notice of Filing, Certificate of Service, and Notice of Appearance, with the Clerk of the Illinois
Pollution Control Board, State of Illinois Center, 100 West Randolph, Suite 11-500, Chicago, Illinois
60601. A copy of said Petition for Review shall be filed with the Illinois Environmental Protection
Agency's Division of Legal Counsel at 1021 North Grand Avenue East, P.O. Box 19276, Springfield,
Illinois 62794-9276. Section 31.1 of the Act provides that any Petition for Review shall be filed
within thirty-five (35) days of the date of service of this Administrative Citation or the Illinois Pollution
Control Board shall enter a default judgment against the Respondents.

Affiant, Michelle E. Cozadd, being first duly sworn, voluntarily deposes and states as
follows:

Affiant is a field inspector employed by the Division of Land Pollution Control of the
Illinois Environmental Protection Agency and has been so employed at all times
pertinent hereto.

On February 7, 2008 between 6:15 AM and 8:45 AM, Affiant conducted an
inspection of a sanitary landfill located in Pike County, Illinois, and known as New
Salem/Pike County Landfill, Inc. by the Illinois Environmental Protection Agency.
Said site has been assigned site number LPC #1498160001, and is operated under
IEPA Permit No. 1995-155-LF, Modification No. 46.

Affiant inspected said New Salem/Pike County Landfill, Inc. landfill site by an on-
site inspection which included walking and photographing the site, and interviewing
personnel.
4.
Before and after said inspection of said New Salem/Pike County Landfill, Inc. landfill
site, Affiant reviewed Illinois Environmental Protection Agency permits issued to the
subject site, and investigated into whether or not required documents were timely
filed on behalf of subject site.

A landfill inspection was conducted at this facility on February 7, 2008 from about 6:15 am to 8:45
am. Thirteen digital photographs were taken and the weather was partly sunny, 25°F with wet and
partially frozen soil conditions. Mr. Larry Beard was interviewed during the inspection. The
applicable permit at the time of the inspection was Permit No. 1995-155-LF, Modification No. 46
("Permit").
Upon arrival at the site on February 7, 2008, I went directly to the active area. No waste had been
accepted prior to my arrival and no personnel had starting working in the area yet. Exposed refuse at
the active face is shown in the attached photos #001 through #007 and #009 through #011. There
were two alternate cover blankets in use. Mr. Beard and I discussed the significant amount of
exposed refuse remaining from the previous operating day. Mr. Beard explained that he left early the
previous day and instructed the assistant manager, Mr. Steve Blake, to cover the waste at the
conclusion of the operating day.
Exposed refuse, in the form of general construction or demolition debris, was also observed during
the November 20, 2007 inspection. The debris included damaged dimensional lumber, bricks,
shingles, plastic, and broken concrete. Mr. Blake was responsible for the site operations on
November 19, 2007 since Mr. Beard was on vacation. On November 20, 2007, Mr. Blake and I
discussed the exposed refuse. Mr. Blake stated that the debris was used as road base materials. I
explained to Mr. Blake that general construction or demolition debris is not allowed to be used as
road base and must be treated as refuse which is covered at the conclusion of the operating day. Mr.
Blake agreed to cover all waste materials, including the general construction or demolition debris, by
the end of the day. The problem was noted in the Illinois EPA's December 14, 2007 letter to Mr.
Ron Edwards.
The foundry sand pile near the active face is shown in the attached photos #008. According to
Special Condition No. 11.25 of the Permit, foundry sand may be stored on the landfill and used for
temporary roads inside the waste limits with the following conditions:
a.
The foundry sand pile will be limited to 100 cubic yards or less.
b.
The foundry sand pile will be covered with tarps or similar materials to prevent nuisance
conditions from developing.
c.
The foundry sand pile will be on an area of the landfill with a composite liner and

leachate collection system.
d. Any water that contacts the foundry sand will be managed as leachate.
The majority of the pile was covered as shown in the attached photo #008. Additional efforts should
be made to ensure the entire pile is covered to prevent nuisance conditions from developing.
Information concerning the groundwater monitoring wells and piezometers is located on the attached
monitor well inspection form. Groundwater monitoring wells G146 and G147 were not observed
during the inspection. All the protective casings observed were locked, labeled and in good
condition. Groundwater monitoring well G127 is shown in the attached photo #012. The well is
located at the top of a small ridge. The concrete surface slab must maintain complete contact with
the ground to prevent the infiltration of surface water runoff into the well annulus. The well should
be monitored for developing erosion issues of the surrounding soil. The concrete surface seal on
groundwater monitoring well G126 should also be monitoring for developing silting issues. The soil
around groundwater monitoring well G126 should be regraded to divert surface water away from the
well casing.
The used oil tank in the maintenance shed is shown in the attached photograph #013. The well was
already labeled "Used Oil" as required by 35 Ill. Adm. Code 739.122(c)(1).
