HEARING OFFICER ORDER
On March 10, 2008, complainant and respondent Cochran and Wilken, Inc. (Cochran)
participated in a telephone status conference with the hearing officer. Complainant had a signed
settlement agreement with all respondents when the Illinois Environmental Protection Agency
(Agency) requested additional changes. According to complainant, the Agency wants the
settlement language to clarify that the Agency is a party to the proceeding. When complainant
receives the revised settlement agreement from the Agency, it will be sent to the respondents.
Counsel for Cochran may file a motion to enforce the original agreement as signed. The parties
hope to resolve this matter quickly, and the next status conference shall be cancelled if the
settlement agreement has been filed with the Board.
The parties are directed to participate in a telephone status conference with the hearing
officer at 10:00 a.m. on June 9, 2008. The status conference shall be initiated by the
complainant.
