This Administrative Citation is issued pursuant to authority vested in the Illinois
Environmental Protection Agency by 415 ILCS 5/1
et. seq.
(2004), specifically 415 ILCS
5/31.1.
FACTS
1.
The Respondent is the present owner and occupant and in control and
possession of a facility located in the County of Jackson, State of Illinois.
2.
The facility is an open dump, operating without an Illinois Environmental
Protection Agency Operating Permit, and designated with the Site Code # 0778085005.
The facility is known to the Agency as the Murphysboro/James Moake site.
3.
The Respondent has owned, occupied, controlled and/or operated the facility at
all relevant times hereto.
4.
On January 9, 2008, Don Terry, Field Inspector, Jackson County Health
Department, inspected the facility. A true and correct copy of the inspection report, along
with Mr. Terry's affidavit, are attached and incorporated herein by reference as Exhibit A.

 
VIOLATIONS
On the basis of Field Inspector, Don Terry's, direct observation, he has determined
that the Respondent has caused or allowed open dumping at the above described facility
in a manner that resulted in the following violations:
That on January 9, 2008, an on-site inspection of the facility disclosed the following:
1. The Respondent has caused or allowed litter at the facility in violation of 415 ILCS
5/21(p)(1).
2. The Respondent caused or allowed open burning at the facility in violation of 415
ILCS 5/21(p)(3).
3. The Respondent has caused or allowed the deposition of general construction
or demolition; or clean construction or demolition debris in violation of 415 ILCS 5/21(p)(7).
CIVIL PENALTY
In accordance with 415 ILCS 5/42 (b)(4-5), the Respondent is subject to a civil
penalty of $1,500.00 for each of violations specified above. Additionally, should the
Respondent elect to petition the Illinois Pollution Control Board under the review process
described below, after an adjudicatory hearing, the Respondent shall be assessed the
hearing costs incurred by the Pollution Control Board. The hearing cost would be in
addition to the $4,500.00 fine.
If you acknowledge the violations cited herein above, the civil penalty shall be due
and payable no later than March 15, 2007. If you do not petition the Pollution Control
Board for review of the Administrative Citation within 35 days of service of the
Administrative Citation, or contest the Citation, any judgment that may be rendered against
you shall specify the due date of the civil fine and any additional costs assessed against

 
you.
When payment is made, your check should be made payable to the Jackson
County's Treasurer Office and mailed to the attention of Shirley Dillinger Booker, Jackson
County Treasurer, Murphysboro, Illinois, 62966. Also, please complete and return the
enclosed remittance form, along with your payment, to assure proper credit.
If any civil penalty is not paid within the prescribed time, the law allows for the
accumulation and payment of interest on the remaining unpaid balance. If any civil penalty
is not paid when due, the Office of the State's Attorney shall be requested to initiate
proceedings in Circuit Court to collect the penalty. In addition to the civil penalty, hearing
costs, and interest, if any, the Jackson County State's Attorney may seek to recover their
costs of litigation.
PROCEDURE FOR CONTESTING ADMINISTRATIVE CITATION
You have the right to contest this Citation, pursuant to 415 ILCS 5/31.1. If you elect
to contest this Citation, you must file a Petition For Review with the Clerk of the Illinois
Pollution Control Board. A copy of the Petition For Review shall be filed with Daniel
Brenner, Assistant State's Attorney, Jackson County Courthouse, Third Floor,
Murphysboro, II 62966.

GENERAL REMARKS
This inspection was made as a follow up to an inspection conducted on September 8, 2004 during
which open dumping violations were observed. Also on January 3, 2007 a field visit of this site
was conducted by this inspector, accompanied by Bart Hagston of the Jackson County Health
Department. During the field visit, this inspector spoke with the owner James Moake. During the
field visit Mr. Moake said he was working on getting the site cleaned up.
During the stated date and time, I conducted an inspection of the site listed above. From my
location near the house I observed that abandoned vehicles and other waste was still open
dumped at the site.
Weather conditions at the time of the inspection were: sunny with calm winds and a temperature
of approximately 46°F. I was accompanied on this inspection by Bart Hagston of the Jackson
County Health Department.
According to the Jackson County Assessor's Office, the site is owned by James Moake Jr.
I arrived at the site and went to the door of the residence. I knocked several times with no
response. From the house I observed waste open dumped on the ground. I then began my
inspection.
North of the house I observed a shed with waste open dumped and scattered all around it
(Photos
#1 - #3, Site Sketch).
The waste include, but was not limited to: plastic and metal containers,
metal barrels, plumbing materials, dimensional lumber and cardboard.
East of the shed, I observed an area of open dumped waste that included, but was not limited to:
scrap metal, fiberglass insulation, waste tires and plastic items
(Photos #4
&
#7, Site Sketch).
In an area east of the house I observed a burn pile
(Photos #5 - #6, Site Sketch).
The waste in
this pile included, but was not limited to: ash, glass, charred dimensional lumber, charred remains
of hydraulic hoses, charred particle board, melted plastic, metal wire, nails and landscape waste
(Photos #5 - #6, Site Sketch).
Also, given that the grass and soil in this area was blackened and
charred, one could conclude that the open burning of waste had occurred at this location.

South of the house I observed a waste pile that consisted of, but was not limited to: filled plastic
bags, a glass bottle, a metal food containers, various plastic containers and a metal gas cylinder

South of this pile I observed two other waste piles

that consisted of, but were not limited to: cardboard and glass bottles
(Photos #9

I walked south and observed an abandoned vehicle
(Photos #11

#12, Site Sketch).
The
vehicle was lacking a wheel, had no current Illinois licence plate and the hood was open exposing
the engine area to the weather

At the time of the inspection,
this vehicle was not in use, was not useable in its current condition, and was not stored in such a
way as to protect any future use.
Southwest of the abandoned vehicle I observed a pile of various types of professional kitchen
equipment which had been open dumped in a field
(Photos #13 - #16, Site Sketch Area A).
Much of the equipment had vegetation growing up around and through it, indicating that this
material had been exposed to the weather for at least one growing season
(Photos #13 - #16,
Site Sketch Area A).
At the time of the inspection, this equipment was not in use, was not
useable in its current condition, and was not stored in such a way as to protect any future use.
Since a commercial kitchen in not located on this site, it would be reasonable to conclude that this
material was transported to this site from another for disposal.
To the south I observed two abandoned vehicles
(Photos #17 - #19, Site Sketch Area B).
I
observed these vehicles did not display current Illinois licence plates. I observed that the blue
vehicle was missing its top allowing the interior to be exposed to the weather and had the remains
of growing vegetation in it

The white vehicle was
missing a door allowing its interior to be exposed to the weather
(Photos #17

Area B).
At the time of the inspection, these vehicle were not in use, were not useable in their
current condition, and were not stored in such a way as to protect any future use. To the east I
observed another abandoned vehicle in a field
(Photo #24, Site Sketch).
This vehicle appeared
to be the same vehicle, sitting in the same general location that I observed during my November 6,
2003 inspection. At the time of the inspection, this vehicle was not in use, was not useable in its
current condition, and was not stored in such a way as to protect any future use.
To the west I observed what appeared to be an abandoned mobile home. I walked west and
observed a pile of PVC pipe that was open dumped

I
continued walking west and observed a mobile home that had been abandoned
(Photos #21
-
#23, Site Sketch Area B).
The mobile home was missing windows and its door allowing the
interior to be exposed to the weather

The door was
lying on the ground broken apart and rotting
(Photo #22, Site Sketch Area B).
I also observed an
abandoned refrigerator lying against the south wall of the mobile home
(Photo #21, Site Sketch
Area B).
At the time of the inspection, the mobile home was not in use, was not useable in its
current condition, and was not stored in such a way as to protect any future use.

To the northeast I observed a waste pile
(Photos #25 & #26,

The waste in
this pile included, but was not limited to: landscape waste, paper, cardboard, plastic and laminated
wood material.
North of this waste pile I observed another waste pile and an abandoned vehicle
(Photos #27
-
#30, Site Sketch Area D).
The waste pile consisted of but was not limited to: dimensional lumber,
plastic pipe and a sign containing fluorescent bulbs. The vehicle appeared to be the same vehicle
I observed during my January 3, 2007 field visit sitting in the same approximate location. I
observed this vehicle was not displaying current Illinois licence plates, was missing a front fender
and had vegetation growing up next to it indicating it had been sitting in this same location for at
least one growing season. At the time of the inspection, this vehicle was not in use, was not
useable in its current condition, and was not stored in such a way as to protect any future use.
The total volume of waste observed at the site was approximately 140 cubic yards.
My inspection ended at approximately 11:48 am.
Violations Observed:
Item #1(9)(a): Cause, threaten or allow air pollution in Illinois; Item #2(9)(c): Cause or allow
open burning; Item #8(21)(p)(3): Cause or allow the open dumping of any waste in a
manner which results in any of the following occurrences at the dump site: (3) Open
Burning:
During the inspection, open dumping that resulted in open burning and which caused,
threatened or allowed air pollution in Illinois was observed.
Item #5(21)(a): Cause or allow open dumping; Item #8(21)(p)(1 and 7): Cause or allow the
open dumping of any waste in a manner which results in any of the following occurrences
at the dump site: (1) Litter and (7) Deposition of general construction or demolition debris;
or clean construction or demolition debris:
During the inspection, the open dumping of waste
that resulted in litter and the deposition of general construction or demolition debris was observed.
Item #6(21)(d)(1): Conduct any waste-storage, waste-treatment, or waste-disposal
operation: Without a permit:
At the time of this inspection, this office had not received from the
Illinois Environmental Protection Agency (Agency) information showing that the site owner had
received a permit from them to conduct a waste-storage, waste-treatment or waste-disposal
operation.

During the
inspection, violations of regulations and standards adopted by the Board regarding litter control
and daily cover were observed.

Item #7(21)(e): Dispose, treat, store, or abandon any waste, or transport any waste into the
State at/to sites not meeting requirements of the Act:
This site does not meet the
requirements of the Act for landfills. Also, given the type and quantity of the waste observed at
this site, one could reasonably conclude that the waste had been transported to this site from
another.
Item #9(55)(a)(1): No person shall: Cause or allow open dumping of any used or waste tire:
During the inspection, waste tires that had been open dumped were observed.
Item #10(812.101)(a): Failure to submit an application for a permit to develop and operate a
landfill:
At the time of this inspection, this office had no information from the Agency that the site
owner had submitted and application to them for a permit to develop and operate a landfill.

At the time of this inspection, this office had not received from the Agency
documentation that the site owner had obtained from them a Developmental Permit to operate a
