ORDER OF THE BOARD (by T.E. Johnson):
On January 30, 2008, petitioner, Gallaher’s Shell, filed a motion to voluntarily dismiss
this appeal of a determination by respondent, the Illinois Environmental Protection Agency
(Agency). In the determination, the Agency denied Gallaher’s Shell reimbursement from the
Underground Storage Tank (UST) Fund concerning the leaking petroleum UST site of Gallaher’s
Shell located at 1580 Mulholland Street in Nauvoo, Hancock County. In its motion, Gallaher’s
Shell states that petitioner and the Agency “have resolved the matter.” Motion at 1. The Board
grants the motion, dismisses this appeal, and closes the docket.
    IT IS SO ORDERED.
I, John Therriault, Assistant Clerk of the Illinois Pollution Control Board, certify that the
Board adopted the above order on February 7, 2008, by a vote of 4-0.
