HEARING REPORT
On January 29, 2008, a hearing in the above-captioned matter was held at the City
Hall, 209 N. York Street, Elmhurst, Illinois. Attorney Meagan Newman appeared and
participated on behalf of the petitioner. Attorney Gerald T. Karr, an Assistant Attorney
General, appeared and participated on behalf of respondent.
Preliminary Matters
On January 18, 2008, the respondent filed a motion for an extension of time to file
the administrative record and a motion to reschedule the hearing. On January 28, 2008,
the respondent filed a motion to withdraw its motion for an extension of time to file the
administrative record and a motion to withdraw its motion to reschedule the hearing. On
January 29, 2008, the petitioner, at hearing, represented that it had no objection to
respondent’s motions to withdraw its respective motions. The respondent’s motions to
withdraw its’ motion for an extension of time to file the administrative record and its’
motion to withdraw its motion to reschedule the hearing was granted.
Witness Credibility
Petitioner’s witness, Robert Harrington, was the only witness to testify. Based
upon my legal judgment, experience, and observations at the hearing, I find that the
credibility of the witness is not an issue in this matter.
Exhibits
The petitioner offered one exhibit at the hearing. The exhibit was accepted into
evidence without objection and was marked as Petitioner’s Exhibit A. Petitioner’s
Exhibit A is an affidavit of Robert Harrington.
Briefing Schedule

A briefing schedule was discussed and agreed to at the hearing. Simultaneous
post- hearing briefs are due to be filed on or before February 20, 2008. The mailbox rule
will not apply. Public comment is due to be filed on or before February 11, 2008.
