JOINT MOTION FOR EXTENSION OF TIME
FOR FILING OF ILLINOIS ENVIRONMENTAL PROTECTION AGENCY
RECOMMENDATION
BFI Waste Systems of North America, Inc. ("BFI"), by its attorneys
McGuireWoods LLP, and the Illinois Environmental Protection Agency ("IEPA"),
hereby jointly move the Illinois Pollution Control Board ("Board"), through its Hearing
Officer Bradley Halloran, to extend the deadline for the submission of the 1-EPA
recommendation in this matter until March 26, 2008.
In support thereof, BFI and IEPA state:
1.
Pursuant to the Order of the Board issued on January 10, 2008, the IEPA
recommendation must be filed on or before February 25, 2008.
2.
The Technical Support Document supporting the Petition in this matter
includes nine years of sampling data and a substantial amount of other supporting
material which IEPA must review in order to make its recommendation.
2. Due to work load and scheduling difficulties, including jury duty for
representatives of both BFI and IEPA, IEPA requires up to 30 days additional time to
review the Petition and to thereafter formulate its recommendation.
3.
It is in the best interest of BFI, IEPA and the Board that TEPA has
sufficient time to review the Petition and to formulate its recommendation.
 
4. BFI hereby waives any right it may be deemed to have under the Board's
regulations or the Illinois Environmental Protection Act to the submission of the IEPA
recommendation before March 26, 2008.
WHEREFORE, BFI and 'TPA jointly move the Board, through its Hearing
Officer, to grant an extension of the deadline for the filing of the IEPA recommendation.
