PETITIONER’S EXTENSION OF HEARING DEADLINE
NOW COMES the Petitioner, Atkinson Landfill Company (“Petitioner”), by its
attorneys Glenn C. Sechen and James R. Griffin, and hereby extends the Hearing
Deadline an additional 40 days to and including May 21, 2008.
WHEREFORE,

AGREED MOTION TO STAY
NOW COMES the Petitioner, Atkinson Landfill Company (“Petitioner”), by its
attorneys Glenn C. Sechen and James R. Griffin, and hereby joins with the Village of
Atkinson (“Village”) and pursuant to
Section 101.514 of the Board’s rules move to stay
this matter. In support hereof the parties state as follows:
1.
The Village of Atkinson passed Resolution 185 granting siting approval
with conditions on August 28, 2006.
2.
The Petitioner and the Village (collectively, the “Parties”) have recently
negotiated in good faith and are near an agreement which could ultimately resolve this
matter.
3.
Recently the Village filed its Response to Petition for Review whereby the
Village admits many of the key elements of the Petition for Review.
4.
The Parties desire to complete their negotiations and investigate potential
changes to its prior application and the cost thereof which may lead to the filing of
another application for siting with the Village.
5.
Should such an application be granted, this matter would be dismissed.

The Parties have agreed and hereby ask the Board to allow either party to
file a Notice to Reinstate pursuant to Section 101.514 of the Board’s Rules.
7.
The current status of this matter would potentially involve the taking of
discovery and the conducting of the necessary public hearing should the stay not be
granted.
8.
Should the Petitioner not move to dismiss as outlined above, the Parties
agree to file status report upon the lifting of the stay, as required.
9.
Additionally, pursuant to Sections 101.308 and 101.514 of the Boards’ rules,
the Petitioner agrees to and hereby does waive the applicable decision deadline.
WHEREFORE,
the Parties together pray that the Board stay this proceeding
upon such additional time limits and reasonable terms as the Board may require.
