states as follows:
1. - 22. The Village admits the allegations of Paragraphs 1. - 22., except
Paragraphs 8. - 10., to which it responds by affirmatively stating as follows:
A. At the special closed session of the Village Board held at 6:00 P.M. on
August 28, 2006, the parties present at that session were:

At this spe'cial closed session, the Atkinson Landfill siting conditions were discussed. At
the conclusion
of the special closed session, the Village Board conducted a special open
meeting at 7:00 P.M. on the same date.

At this special open meeting, the same individuals set forth above were
present, along with the following persons:

After a general discussion period where all present participated, the Village Board passed
Resolution No. 185. The Village admits that the passage
of this Resolution was not based
upon specific evidence submitted at the siting hearing.
WHEREFORE, the Village submits the issue
of relief to the discretion of
the Illinois Pollution Control Board.
