HEARING OFFICER ORDER
On December 15, 2005, the Board granted complainant’s motion to stay this
proceeding until such time as the Board orders otherwise. On December 17, 2007, the
parties reported that USEPA and DOJ are meeting next month to continue negotiations as
part of a joint federal and state global initiative against respondent. However, the parties
report that settlement is still a long way off, thus complainant does not currently plan to
request that the stay be lifted.
The parties are directed to participate in a telephone status conference with the
hearing officer at 10:00 a.m. on June 30, 2008. The status conference shall be initiated
by the complainant.
