HEARING OFFICER ORDER
Last week, the hearing officer became aware that her name and address was used
on a mass mailing distributed by Peoria Families Against Toxic Waste (PFATW). The
mailing contained incorrect information that public comment should be served on the
hearing officer. Unfortunately, the mailing contained no return address or contact
information for anyone at PFATW. If PFATW had contacted the hearing officer prior to
this mass distribution, the hearing officer would have informed PFATW that public
comment must be served on the Board’s Clerk in Chicago, and that service on the hearing
officer does not constitute service on the Board. (35 Ill. Adm. Code 101.302.)
As a result, the hearing officer has received a substantial amount of public
comment, including more than 100 pre-printed post cards. The hearing officer assumes
no responsibility for public comment that was not served in accordance with the Board’s
procedural rules. However, as a courtesy, the hearing officer will forward public
comment she receives to the Clerk’s Office.
