HEARING OFFICER ORDER
On October 26, 2007, the Illinois Environmental Protection Agency (Agency)
filed a proposal under the general rulemaking provisions of Sections 27 and 28 of the
Environmental Protection Act (Act) (415 ILCS 5/27, 28 (2006)). Generally, the proposal
will amend the Board's rules for Secondary Contact and Indigenous Aquatic Life Uses to

update the designated uses and criteria necessary to protect the existing uses. On
November 1, 2007, the Board accepted the proposal for hearing.
On November 15, 2007, the Board granted a motion to hold hearings in Chicago
and Joliet. Today's order sets the dates for the hearings, but the specific locations in
Chicago and Joliet will be announced in December. The first hearing, in Chicago, will be
dedicated to presentation of testimony and evidence by the Agency. The second hearing
will be dedicated to testimony by any persons, including the Agency.
Prefiling Deadlines
The Agency must file its prefiled testimony for the first hearing in this proceeding
by December 21, 2007. Also, in an attempt to expedite the hearings, I am ordering
questions for the Agency to be prefiled by January 18, 2008.
Persons wishing to testify at the second hearing must prefile their testimony by
February 19, 2008. In a further attempt to expedite the hearings, I am ordering prefiled
questions to the testimony be filed by March 3, 2008.
Schedule of Hearings
All testimony will be taken as if read and
brief
summaries will be allowed if a
witness insists; however, I prefer we begin with cross-examination immediately. Persons
who do not prefile testimony will only be allowed to testify if time permits at the close of
prefiled testimony. The same is true of anyone wishing to make an oral public comment.
I urge anyone wishing to testify to prefile to ensure your ability to testify. As a reminder,
anyone may file a written public comment with the Board.
Prefiling of questions is not a prerequisite to asking a question. We will begin
with questions that have been prefiled; however anyone may ask follow-up questions.
After completing the prefiled questions, anyone else may ask a question.
