HEARING OFFICER ORDER
On November 20, 2007, a telephonic status conference with the hearing officer
was held. Respondent did not appear. The petitioner represented that discussions
continue and that a settlement meeting was recently held. It appears that there remains
one outstanding issue and that the parties are exchanging appropriate language. The
petitioner represented that the above-captioned matter is related to two other permit
appeals before the Board. By agreement, the record in this matter is now due on or
before February 7, 2008. The petitioner represented that it will file an additional 60-day
waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic
status conference on January 24, 2008, at 11:15 a.m. The status conference must be
initiated by the petitioner, but each party is nonetheless responsible for its own
appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
