MOTION FOR EXTENSION OF TIME
IN WHICH TO FILE A RESPONSE
NOW COMES the Illinois
Environm~ntal
Protection Agency ("Illinois EPA"), by and
through one
of its attorneys, Stephanie Flowers, and pursuant to 35 Ill. Adm. Code 101.500(d)
and 101.522, requests that the Hearing Officer for the Illinois Pollution Control Board ("Board")
grant the Illinois
EPA a two week extension, until December 3, 2007, in which to file a response
to the Rule Proposal Amendment filed with the Illinois Pollution Control Board ("Board")
by
the Association ofResponsible Recyclers ("NORA") in the above-entitled matter on November 5
2007.
In
support of its motion, the Illinois EPA states the following:

That1the document delivered to the Board on November 5, 2007 and titled
Rule Proposal Amendment was not styled as a motion.
That the Illinois
EPA has only recently learned that the Board does intend
to classify the Rule Proposal Amendment as a motion triggering a 14-day
time limit for the Illinois EP
A'sresponse to the motion.
That the 14-day period in which the Illinois
EPA has to respond to the
motion ends during the week
of a holiday and due to time off and vacation
time
of legal counsel and technical staff

is insufficient time to
provide an adequate response to the Rule Proposal Amendment.

That an additional two-week period allowed to the Illinois EPA to respond
to
NORA's motion will not adversely affect this rulemaking.
WHEREFORE, the Illinois EPA respectfully requests that the Hearing Officer in this
rulemaking grant this motion and agree to allow the Illinois EPA a two week extension,
until December
3,2007, in which to file its response.
