HEARING OFFICER ORDER
On October 4, 2007, a telephonic status conference was held. The complainant
represented that settlement negotiations were proceeding with respondent Metropolitan Water
Reclamation District of Greater Chicago, Illinois (MWRDGC) and that the negotiations have
progressed to the point that the complainant anticipates settlement of all issues with MWRDGC
without the necessity of a hearing.
The following agreed discovery schedule is as follows. Written discovery is extended in
this matter to permit the parties to review and follow up on discovery that has been produced
pursuant to their respective requests and also permit any parties wishing to do so, to serve
subpoenas on non-party witnesses, including specifically complainant’s request to subpoena
various consultants. The subpoenas must be served no later than October 29, 2007, with
responses due on or before November 26, 2007. No overall discovery cut-off has been
established. Due to complainant’s anticipated settlement with MWRDGC, MWRDGC is not
included in this discovery schedule.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on December 6, 2007, at 11:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. The complainant represented that it will notify the parties and the hearing
officer of a call-in number prior to the next telephonic status conference. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matter and
their readiness for hearing.
