HEARING REPORT
On August 28, 2007, a hearing in this matter was held at the Madison County
Administration Building in Edwardsville, Illinois. Attorneys Bradley Hiles and Alison
Nelson appeared on behalf of the petitioner. Attorney Sanjay Sofat appeared on behalf of
the Illinois Environmental Protection Agency (Agency)

Witness Credibility

Based upon my legal judgment, experience, and observations at hearing, I find that the
credibility of witness is not an issue in this matter.

Exhibits
A list itemizing the offered exhibits and summarizing their status is attached to
this order. All exhibits were offered by the petitioner. The Agency objected to exhibits
10 and 11, arguing that the entire deposition testimony should be entered rather than just
select testimony. Petitioner did not have the entire testimony at hearing, but agreed to
submit the entire testimony as “Amended Exhibit 10” and “Amended Exhibit 11” post-
hearing. The Agency did not object to the admission of any other exhibits.

Briefing Schedule
