ORDER OF THE BOARD (by T.E. Johnson):
On July 23, 2007, petitioner, E & L Trucking Company (E & L), filed a motion to
dismiss this underground storage tank appeal. E & L states that “the parties have entered into a
settlement in which the matters at issue have been resolved and allows the unresolved costs to be
resubmitted as indicated therein.” Motion at 1. Although respondent, the Illinois Environmental
Protection Agency (Agency), does not object to the granting of the motion, E & L states that the
Agency “makes no representations or inferences as to the outcome of any review of any
resubmission of those unresolved costs.”
Id
. The Board grants the motion, dismisses this case,
and closes the docket.
