    ORDER OF THE BOARD (by G.T. Girard):
    On May 16, 2007, the parties timely filed a joint notice to extend the 35-day period
    within which Dynegy Midwest Generation, Inc. (petitioner) may appeal an April 16, 2007
    determination of the Illinois Environmental Protection Agency (Agency).

    5/40(a)(1) (2004); 35 Ill. Adm. Code 105.204, 105.208. The Agency granted a permit to
    petitioner for construction and operation of baghouse, scrubber, and sorbent injection control for
    units at the Havana Power Station located at 15260 N. State Route 78, in Havana, Mason
    County.
    The Board extends the appeal period until August 27, 2007, as the parties’ request.

    before that date, the Board will dismiss this case and close the docket.
