HEARING OFFICER ORDER
On June 14, 2007, all parties participated in a telephonic status conference with
the hearing officer. It was agreed that a hearing in the above-captioned matter will be
held on July 16 and 17, 2007. The time and location will be noted in the notice of
hearing.
It was also agreed that any written discovery must be served on or before June 18,
2007. Responses must be served on or before June 28, 2007. Depositions must be
completed on or before July 9, 2007. The discovery schedule may be revisited on or
before July 2, 2007.
The applicant, The City of Rochelle, represented that it will file a waiver of the
statutory decision deadline to and including October 18, 2007. To that end, it was agreed
that the briefing schedule is as follows. Opening briefs are due to be filed on or before
August 1, 2007. Responsive briefs are due to be filed on or before August 31, 2007.
Replies, if any, are due to be filed on or before September 14, 2007.

The parties are advised that any pre-hearing motions, including motions
-in-
limine
, must be filed on or before July 5, 2007. The mailbox rule will not apply to these
motions.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on July 2, 2007, at 1:00 p.m. Counsel for
Rochelle Waste Disposal, L.L.C., represented that it will notify the parties and the
hearing officer of a call-in number prior to the next telephonic status conference. At the
status conference, the parties must be prepared to discuss the status of the above-
captioned matters and their readiness for hearing.
